The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No. 51 of 2019, registered for the offence under Sections 379, 414 and 34 of the Indian Penal Code and Section 136 of Electricity Act, pending in the Court of learned Additional Sessions Judge-IV, Chatra. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner of a crane and allegations are made that for installing the electrical pole, the said crane was being used. He next submits that a person was sitting in a car and he was instrumental in using the said crane in loading of the electrical pole on the trailor. He then submits that the said person, who was instrumental to load the electrical pole on the trailor has already been provided the privilege of anticipatory bail by this court in A.B.A. No. 5706 of 2025. He also submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-6 of the petition. On these grounds, he submits that anticipatory bail may kindly be provided [2026:JHHC:21651] -2- to the petitioner. 4. Learned A.P.P. appearing for the State and learned counsel appearing for the JUVNL jointly opposed the prayer and submit that the petitioner is the owner of the crane. On this ground, they submit that anticipatory bail may kindly be rejected. 5. In the FIR, there is allegation that the person, who was sitting in a car was instrumental in loading of the electrical pole by way of using the said crane and he has already been provided the privilege of anticipatory bail in the aforementioned A.B.A. by this court and further petitioner is only said to be the owner of that crane, which is a commercial vehicle and the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-6 of the petition and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, above named. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IV, Chatra, in connection with Itkhori P.S.
