Learned counsel for the petitioner would submit that respondent No.5 has called for tenders for the execution of the aforementioned works. The petitioner emerged as the successful bidder, and an agreement was entered into vide No.Nil/2022-2023, dated 26.07.2022. The petitioner has completed the work; however, the respondents failed to release the amount. 4. A counter-affidavit was filed on behalf of respondent No.7. In para No.6, it was pleaded that the Executive Engineer records M-book and passed the order dated 02.11.2024, 12.11.2024 and 13.11.2024 concerning Agreement No.Nil/2022-23, dated 26.07.2022 for the Gross amount of Rs.1,54,64,669/-. After statutory deductions and Q.C. recoveries of Rs.11,04,468/-, the net amount payable to the petitioner is Rs.1,43,60,201/-. 5. Learned counsel for the petitioner did not refute the averments made in the counter-affidavit vis-à-vis the amount mentioned therein. 6. Thus, as seen from the averments made in the counter-affidavit filed on behalf of respondent No.7, there is no dispute regarding the execution of works and the petitioner’s entitlement for Rs.1,43,60,201/-. Since the amount payable is admitted and undisputed, the writ petition is maintainable. In M/s Utkal Highways Engineers and Contractors v. Chief General Manager & Ors1, it was held at Para No.8 as under: “Be that as it may, the High court has not dealt with the merits of the writ petition. Moreover, it is not an inviolable rule that no money claim can be adjudicated upon in exercise of writ jurisdiction. Non-payment of admitted dues, inter alia, may be considered an arbitrary action on the part of respondents and for claiming the same, a writ petition may lie.Further, throwing a writ petition on ground of availability of alternative remedy after 10 years, particularly, when parties have exchanged their affidavits, is not the correct course unless there are disputed questions of fact which by their very nature cannot be adjudicated upon without recording formal evidence.”. 7. Given the averments made in the counter-affidavit was filed on behalf of respondent No.7, the Writ Petition is disposed of, directing the respondents to p. 5 1 2025 SCC online SC 1400 release an amount of Rs.1,43,60,201/- payable to the petitioner regarding execution of the aforementioned works, within six (06) months from the date of receipt of the copy of this order. With respect to the interest claimed, the petitioner has to approach the appropriate forum. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI Date: 11.03.2026 TVN p. 6 235 THE HONOURABLE SRI JUSTICE SUBBA REDDY SATTI WRIT PETITION NO: 14730 of 2025 Date: 11.03.2026 TVN
