1. Instant writ petition under Article 226 of Constitution of India has been preferred by the petitioner seeking following reliefs :- (I) That, this Hon’ble Court may kindly be pleased to call for all the records pertaining to the case of the petitioner from the respondents.
2 (ii) That, this Hon’ble Court may kindly be pleased to direct the respondents to record the 1.163 hectare of land out of Khasra No. 85/1 situated at Village Karichapar, P.H. No. 21, Tahsil Pussore, District Raigarh (C.G.) as service land of the petitioner. (iii) Any other relief, which this Hon’ble Court deems fit any proper, may also kindly be granted to the petitioner, in the interest of justice.”

Learned counsel appearing for the petitioner submitted that the petitioner is discharging his duties as Kotwar of Village Karichpar, Police Station and Tehsil Pussor, District Raigarh (C.G.) since the time of his grandfather for the last three decades. They have been allotted 7 ½ acres government land as service land, whereas, as per Circular issued by the erstwhile State of Madhya Pradesh on 30th November, 1983 (Annexure P-1), Kotwars ought to have allotted 10 acres of government land as service land, therefore, the petitioner has moved an application (Annexure P-4) before Tahsildar, Pussour, District Raigarh (C.G.) dated 04.07.2022 and in pursuance of the direction issued by Tahsildar, Pussor, spot map has already been prepared, despite that aforesaid application filed by the petitioner has not been decided yet. Hence, learned counsel for the petitioner submits that this petition may be disposed of directing respondent No. 4 to decide the application (Annexure P-4) dated 04.07.2022 filed by the petitioner within a specific time frame.

Learned counsel for the respondent has no objection to allow the limited prayer made by counsel for the petitioner.
4. After due consideration and in light of the Circular dated 30.11.1983 (Annexure P-1) issued by erstwhile State of Madhya Pradesh, limited prayer made by counsel of the petitioner is allowed.
5. Accordingly, the instant writ petition is disposed of directing respondent No. 4 to decide the application dated 04.07.2022 (Annexure P-4) filed by the petitioner as early as possible, preferably within a period of sixty days from the date of receipt /
3 submission of copy of this order in accordance with law. Ordered accordingly.
6. It is made clearly that the petitioner may also enclose copy of aforesaid application dated 04.07.2022 (Annexure P-4) along with copy of this order.
7. With the aforesaid observations & directions, instant writ petition stands
disposed of.
