Petitioners, who are apprehending arrest in Crime No.18/2026 registered by Jalahalli Police Station for the offences punishable under Sections 408, 420 and 417 of IPC, are before this Court in this criminal petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard the learned counsel appearing for the petitioners and learned Addl. SPP appearing for the respondent-State. 3. FIR in Crime No.18/2026 was registered by Jalahalli Police Station against one Yellappa Dyamannavar and others based on the information dated 05.02.2026 received from Bharath.R., Incharge Chief Executive, Bharat Electronics Employees Co-operative House Building Society Limited. Apprehending arrest in the said case, petitioners had filed Criminal Misc.No.1286/2026, which - 5 - HC-KAR NC: 2026:KHC:28806 CRL.P No. 4271 of 2026 was dismissed on 24.02.2026. Therefore, they are before this Court. 4. Perusal of material on record would go to show that the petitioners were office bearers of the said Housing Cooperative Society during the years 2021 to 2023. Subsequently, the Management of the Society was changed and based on the first information received from the new Management of the Co-operative Society, aforesaid FIR in Crime No.18/2026 was registered by Jalahalli Police Station with allegation that the petitioners had committed the aforesaid offences by executing sale deeds with respect to the sites belonging to the Society, by violating the seniority of the members and also by selling the sites for a lesser price than the guideline value. 5. The alleged offences are triable by the Court of Magistrate and maximum punishment for the aforesaid offences is for a period of 7 years. Petitioners are persons without criminal antecedents and have undertaken to cooperate with the police for the purpose of investigation. - 6 - HC-KAR NC: 2026:KHC:28806 CRL.P No. 4271 of 2026 All the documents are in the custody of the Complainant- Society and therefore, there cannot be any apprehension that the petitioners may tamper with the same. 6. Under the circumstances, the following order: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.18/2026 registered by Jalahalli Police Station for the offences punishable under Sections 408, 420 and 417 of IPC, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. - 7 - HC-KAR NC: 2026:KHC:28806 CRL.P No. 4271 of 2026 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and shall co-operate with the police for investigation and appear before them whenever called upon. 4.
