Sharma, Additional Advocate General. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge Petitioner was promoted as Principal (School Cadre) in April, 2026 and posted as such at GSSS Rohanda, District Mandi. He has instituted this writ petition seeking direction to the respondents to consider his request for posting him at a station, which has barrier free excess. Prayer has been made on the ground that the petitioner is suffering from 60% permanent disability, viz. Post Polio Paralysis of legs. 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 2. During hearing of the case, learned counsel for the petitioner placed on record incumbency of the petitioner, which reflects that ever since the year 2000, petitioner has remained posted only in District Mandi. Learned counsel for the petitioner also fairly submitted that distance between the stations where the petitioner has remained posted has not been more than around 20 kilometers. That the present place, where the petitioner has been posted in April, 2026 consequent to his promotion as Principal, is at a distance of 17 kilometers from his previous place of posting at GSSS (Girls) Sundernagar, District Mandi. Learned counsel for the petitioner, however, makes out a grievance that at petitioner’s present place of posting, i.e. GSSS Rohanda, barrier free excess/ environment is not available inasmuch as the petitioner has to cross steps/stairs in order to reach the school. That the petitioner would be willing for posting at any station, which has barrier free excess. 4. In that view of the matter, this writ petition is disposed of reserving liberty to the petitioner to represent to respondent No.1/competent authority for the redressal of his grievance concerning posting at a school, which has 3 barrier free excess. In case such a representation is so made within a week from today, the same shall be considered and decided in accordance with law and applicable transfer policy within a period of three weeks thereafter. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
