Learned counsel for the petitioner submits that the petitioner is in custody in connection with Gola P.S. Case No. 46 of 2026 for the offences registered under Sections 126 (2), 127(2), 115 (2), 109, 303 (2), 333, 3(5) of the B.N.S. 2023, pending in the court of learned J.M.F.C., Ramgarh. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 04.05.2026 and charge sheet has already been submitted. He submits that as per the allegation in the FIR, there is general and omnibus allegation against all the four persons and only simply injury has been found. 4. Learned counsel for the opposite party-State and the informant have opposed the prayer for bail and have submitted that there are serious allegation in the FIR itself which reveals that the victim mother-in-law of the informant aged 60 years was brutally assaulted and there are as many as 16 stiches on her head. 5. At this, the learned counsel for the petitioner submitted that co- accused Kajal Karmali has been enlarged on bail by the learned Sessions Judge. 6. The learned counsel for the informant has submitted that in the impugned order it has been mentioned that it was the petitioner who assaulted the victim and therefore the bail application of the petitioner was rejected and the bail was granted to Kajal Karmali. After hearing the learned counsel for the parties and after considering the manner in which offence has been committed, the victim has suffered as many as 16 stiches and charge sheet has been submitted against two persons the petitioner and Kajal Karmali and the case of Kajal Karmali certainly stands on different footing from that of the petitioner as indicated by the learned counsel for the informant , this court is not inclined to enlarge the petitioner on bail. Accordingly, prayer for bail of the petitioner above named is rejected. 8. Let this order be communicated to the concerned court through FAX/e-mail. (Anubha Rawat Choudhary, J.)
