NATARAJ Digitally signed by HEMALATHA J Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC:27918 WP No. 4497 of 2026 ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct the respondent to send the records to the Civil Court for apportionment and adjudication by considering the representation dated 15.02.2025. 2. (i) The petitioner contends that the land in Sy.No.36/1B, New Sy.No.36/6 of Marase Village, Varuna Hobli, Mysuru Taluk, measuring 1 acre 13 guntas was acquired showing the name of one Smt.Siddamma, as the occupant of the land. The petitioner contends that the said Smt.Siddamma had managed to obtain an order from the office of the Assistant Commissioner in R.A.No.171/2017 and got the name of her husband, Sri.Kuntamarigowda entered in the revenue records. He contends that the said order was challenged before the Deputy Commissioner, which was dismissed on 25.05.2022. (ii) He also contends that a suit in O.S.No.784/2022 is now pending consideration before the Principal Senior Civil Judge, J.M.F.C., Mysore. It is contended that taking advantage of the aforesaid order, the compensation is sought to be - 3 - HC-KAR NC: 2026:KHC:27918 WP No. 4497 of 2026 received by Smt.Siddamma, who claims to be the wife of Sri.Kuntamarigowda. 3. The petitioner claims that a representation was also filed before the respondent, informing him about the dispute and objection against releasing the compensation in favour of Smt.Siddamma but the said representation is not considered and therefore, the petitioner is before this Court seeking for a direction to the respondent. 4. Learned counsel for the respondent submits that the award passed in respect of the acquisition of the above land is now approved by the competent authority and that in view of the dispute raised by the petitioner, the award would be forwarded to the Civil Court in the manner known to law. 5. In view of the above submission, the respondent is directed to refer the dispute before the Civil Court in accordance with law.
