1. The petitioner seeks quashing of FIR No.0081/2019, registered under Sections 356/379/411 of the Indian Penal Code (“IPC”) registered at P.S. Laxmi Nagar, Delhi and the proceedings emanating therefrom. 2. The present petition has been filed on the basis of a Settlement Agreement dated 25.05.2026 entered into between the petitioner and the respondent no.2 / complainant. 3. The background of the matter is that, on 31.03.2019, the petitioner, who was then aged about 22 years, is alleged to have snatched the mobile phone of respondent no. 2 while riding a scooty. Respondent no. 2 managed to apprehend the petitioner by getting hold of the scooty, whereupon the petitioner was apprehended at the spot along with the mobile phone.
CRL.M.C. 7524/2026 p. 2 4. The mobile phone was recovered and subsequently returned to the complainant. It is further stated that no injury was caused to any person in the incident. 5. It is informed that a charge-sheet has been filed against the petitioner alone pursuant to the aforesaid FIR. 6. The petitioner and respondent no.2 are identified by the Investigating Officer (IO), who is present in Court. 7. The complainant submits that the petitioner has apologized and is desirous of settling the matter of his own free will and he has no objection to the quashing of the aforesaid FIR. 8. Although in this case, the offence was committed in public, this Court notices that the attempt to snatch the complainant’s mobile phone failed at the spot, and the property was recovered immediately. Moreover, it is also noticed that no weapon was used and no injury was caused in the incident, and that the petitioner has no antecedents. 9.
In terms of the dicta laid down by Supreme Court in Gian Singh v. State of Punjab (2012) 10 SCC 303 and Narinder Singh v. State of Punjab (2014) 6 SCC 466, there is no impediment to acceding to the joint request of the petitioner and the respondent no.2 for quashing of the aforesaid FIR. 10. In the circumstances, the present petition is allowed. 11. Accordingly, the FIR No.0081/2019 and all proceedings emanating therefrom are quashed. 12. Pending applications also stand disposed of.
