Learned counsel for the petitioner submits that the petitioner is in custody since 18.05.2026 in connection with Telaiya P.S. Case No.24 of 2026, registered under Sections 69, 89, 115 (2), 126 (2), 127 (2), 352, 351 (2) of Bhartiya Nyaya Sanhita, 2023, now pending in the court of learned ACJM, Koderma. 3. The learned counsel for the petitioner submits that the victim was major and in the F.I.R. itself, which was lodged by the victim, she declared her as age as 18 years. However, the charge sheet has been submitted under Section 6 of POCSO Act. 4. At this, the learned counsel for the petitioner has submitted that the parties have settled the dispute outside the court. 5. After hearing the learned counsels for the parties and considering the statement of the victim recorded under Section 183 BNSS, wherein specific and direct allegations have been made against the petitioner that the petitioner allured the victim, established physical relationship with her, as a result of which she became pregnant and was subsequently subjected to abortion, this Court is not 2026:JHHC:21708 2 inclined to enlarge the petitioner on bail.
