This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.123/2025, registered at Police Station - Chandaura, District – Surajpur (C.G.) for commission of offence punishable under Sections 103 and 238 of Bharatiya Nyaya Sanhita, 2023. 2. Case of prosecution in brief, is that on 21.12.2025 the complainant Rudra Prasad, Sarpanch, Gram Panchayat, Pahiya lodged report at Police Station Chandaura to the effect that one Chhadan Gond intimated him that one lady was lying dead beside the road at Salyapahri Jungle. On the basis of said information, the complainant went to the place of incident and found that one unknown lady is lying dead. On the basis of the said report, PRAKASH KUMAR Digitally signed by PRAKASH KUMAR Date: 2026.06.17 17:35:04 +0530 2 the aforesaid offence was registered against the unknown person and during course of investigation, the applicant has been arrested on 04.02.2026 on the basis of his memorandum. 3. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. He further submits that there is no evidence available on record against the applicant except the memorandum statement from where the alleged motorcycle has been seized from him. He further submits that applicant is in jail since 04.02.2026, charge-sheet has been filed and trial is likely to take some time, therefore, it is prayed that applicant may be enlarged on bail. 4. Learned State Counsel opposes the bail application filed by the applicant. He further submits that there is evidence of last seen together against the applicant. He further submits that one motorcycle which was used in the commission of the alleged offence, has been recovered from the memorandum of the applicant/accused. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and gravity of the offence, and other materials available in the case diary, without further commenting on merits of the case, I am not inclined to grant bail to the applicant. 7.
