1. The present petition is being filed assailing the order dated Orders dated 27/11/2021 passed by the Ld. Regulatory Commission/Respondent No.1 in Petition Nos 46/2019 (M) and 17/2020(M) wherein the Hon'ble Commission disposed off the subject petitioners without according an opportunity of hearing to the petitioner herein. Hence, being aggrieved by the impugned
order, the Petitioner is filing the present petition.
2. Following reliefs have been prayed by way of this petition:-
“I. That this Hon'ble Court may kindly be pleased to quash and set aside the Orders dated 27/11/2021 passed by passed by the Ld. Chhattisgarh State Electricity Regulatory Commission in Petition nos 46/2019 (M) and 17/2020(M); ii. That this Hon'ble Court may kindly be pleased to issue a writ of mandamus to the respondent No. 1 to decide the Petition nos 46/2019 (M) and 17/2020(M) afresh after affording proper opportunity of hearing to the Petitioner in accordance with law. iii. To pass any other and further relief as this Hon'ble Court may deem fit in the interest of justice.”
3. Learned counsel for respondent No. 1 submits that an efficacious alternative remedy is available to the petitioner under Section 111 of the Electricity Act, and that the petitioner, without availing the said statutory remedy, has directly approached this Court. It is,
3 therefore, submitted that the present petition is not maintainable in view of the availability of the alternative remedy under the statute.

On the other hand, learned counsel for the petitioner submits that the petitioner may be permitted to approach the Appellate Tribunal, where an alternative statutory remedy is available under the law. It is, therefore, prayed that appropriate liberty be granted to the petitioner to avail the said remedy before the competent appellate forum.
5. Having considered the facts and circumstances of the case and upon perusal of Section 111 of the Electricity Act, it appears that against an order passed by the adjudicating officer under the said Act, the aggrieved party is required to prefer an appeal before the Appellate Tribunal constituted under the Act.
6. In the present case, however, the petitioner has not availed the said statutory remedy of appeal. In view of the availability of an efficacious alternative remedy under the law, the petitioner is relegated to avail the same in accordance with law.
7. Accordingly, the petition stands disposed of with liberty to the petitioner to approach the competent Appellate Tribunal. sd/- (Amitendra Kishore Prasad) Judge Vishakha
