The petitioner is apprehending his arrest in connection with Garhwa (SC/ST) P.S. Case No.10 of 2025, for the alleged offences registered under Sections 64, 352, 351(2) & 351(3) of Bharatiya Nyaya Sanhita, 2023, Sections 4 & 6 of the POCSO Act and Sections 3(1)(r), 3(1)(s), 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, pending in the Court of learned Additional Sessions Judge-I-cum-Special Judge SC/ST (POA) Act, Garhwa, Jharkhand. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and it has been alleged that the relationship was established on the false pretext of marriage. He further submits that so far making the video viral is concerned, that is also false against against the petitioner. Neutral Citation No. ( 2026:JHHC:2290 ) --2-- 4. Learned counsel appearing for the State as well as informant jointly opposes the prayer and submits that serious allegations are there against the petitioner of making the video of the victim viral. 5. Considering the fact that making the video viral, the petitioner’s conduct transcended the boundaries of a mere friendship. If a person is in friendship, it does not entitle one party to exploit the other’s vulnerability or dignity. The argument of establishing relationship on the pretext of marriage is a specious argument that cannot absolve the petitioner of the allegations levelled against him for making the video viral on his account. 6. In view of the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected.
