CWP-18218-2026 (O&M) 1 IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH Sr. No.151 CWP-18218-2026 (O&M) Date of decision: 29.05.2026 ASI/LR Paramjit Singh ..... Petitioner VERSUS State of Punjab and others ..... Respondents CORAM: HON’BLE MR. JUSTICE DEEPINDER SINGH NALWA Present: Mr. A.S. Gulati, Advocate, for the petitioner. ***** DEEPINDER SINGH NALWA, J.(Oral) 1 In the present writ petition, the petitioner has challenged the order dated 15.05.2026 (Annexure P-5), vide which, the petitioner has been repatriated to his parent department i.e. Indian Reserve Battalion (hereinafter referred to as the ‘IRB’). 2. Brief facts of the case are that the petitioner was appointed in 3rd IRB. He was sent on deputation to the Department of Vigilance and Security, Punjab State Power Corporation Limited (PSPCL) vide order dated 05.08.2024 passed by the Additional Director General of Police, State Armed Police, Jalandhar. Vide order dated 15.05.2026 (Annexure P-5), the petitioner has been repatriated to the parent department i.e. IRB RAMANDEEP SINGH 2026.05.29 17:20 I attest to the accuracy and integrity of this document CWP-18218-2026 (O&M) 2 on administrative reasons. Aggrieved against the abovesaid order, the petitioner has filed the present writ petition. 3. Learned counsel appearing on behalf of the petitioner submits that as the petitioner has attained the age of 57 years and is going to retire in the coming year and he is also suffering from health issues, as such, he may be permitted to continue in the borrowing department till he attains the age of superannuation. 4. Notice of motion. 5. Mr. N.P.S. Hira, DAG, Punjab, accepts notice on behalf of the respondents-State. 6. A perusal of the facts of the present case would show that the parent department of the petitioner is IRB. He was sent on deputation to Punjab State Power Corporation Limited (PSPCL). It is settled law that the employee on deputation does not have a right to continue in the borrowing department. The employee on deputation retains his lien in the parent department and cannot insist to continue work in borrowing department. No rules have been brought to the notice of this Court that the petitioner has a right to continue on deputation till he attains the age of superannuation in the borrowing department i.e. PSPCL. 7. In view of the above, this Court finds no merit in the present writ petition and the same is accordingly, dismissed. RAMANDEEP SINGH 2026.05.29 17:20 I attest to the accuracy and integrity of this document CWP-18218-2026 (O&M) 3 8. Pending miscellaneous application(s), if any, also stands disposed of.
