JUSTICE RAJESH MAZUMDAR ORDER 21.01.2026 Heard Mr S Borthakur, learned counsel appearing for the petitioner. Also heard Mr A Dutta, learned Special Public Prosecutor for the State of Assam. 2. This application has been filed praying for modification of the condition No. “e” in Bail Order dated 11.10.2018, passed by this Court in Bail Application No. 2170/2018. The said condition is reproduced hereiunder for an easy reference:- “11.10.2018 Page No.# 2/2 ***** ***** ***** ***** ***** ***** ***** ***** (e) They would not leave the territorial limits of the Trial Court without the written permission of the Trial Court.” 3. The learned counsel for the petitioner has submitted that the petitioner has been cooperating with the trial and is also ready to further attend all proceedings in the trial. However, a modification in the aforesaid condition would enable the petitioner to arrange for his livelihood during the time of the trial. 4. The learned Special Public Prosecutor has drawn the attention of this Court to the order dated 25.02.2022, whereby a earlier similar prayer had been rejected by this Court. 5. The learned counsel for the petitioner has submitted that that was at the initial stage and now with the passage of time, it has become necessary that the aforesaid condition may be modified. 6. Having due consideration to the submissions made, this Court is of the opinion that the aforesaid order dated 11.10.2018, passed by this Court in Bail Application of. 2170/2018, can be modified to the extent of deleting the aforesaid condition as has been done by this Court in other similar cases relating to the same trial. Accordingly, Clause- (e) of aforesaid order dated 11.10.2018, passed by this Court in Bail Application of. 2170/2018, stands deleted. 7.
