APHC010286812021 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3457] TUESDAY,THE SIXTH DAY OF JANUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 16765/2021 Between: K.venkata Satya Murthi Srinivas ...PETITIONER AND The Commissioner and Others ...RESPONDENT(S) Counsel for the Petitioner:
1.THOTA RAMAKOTESWARA RAO Counsel for the Respondent(S):
1.GP FOR REVENUE (AP) 2.M MANOHAR REDDY (SC FOR MUNC AND MUNC CORP ) The Court made the following:
2 THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION No.16765 OF 2021 ORDER :
1. The petitioner is aggrieved by the inaction on the part of respondent Nos.1 and 2 in conducting a survey and fixing the boundaries of the petitioner’s property. 2. The learned counsel for the petitioner submits that the petitioner submitted a representation dated 23.07.2021 to the respondent authority and that the respondent authorities failed to fix the boundaries though the respondent authorities visited the site. 3. The learned standing counsel appearing for respondents 1 and 2 has filed a counter and submitted that the respondent authorities conducted a survey on 23.07.2021 and determined that the petitioner is in possession of the land on the eastern and western sides to the extent of the measurements as per the documents. However, the measurements towards the northern and southern sides do not tally, and the ground measurements are less than those mentioned in the documents. 4. The learned counsel for petitioner submits that when the petitioner submitted an application seeking a survey of his property and issue a survey report by fixing the boundaries, the proceedings dated 23.07.2021 did not meet the requirements of the petitioner. 5. Heard the learned counsel for the petitioner and the learned standing counsel for respondent Nos.1 and 2. Perused the material on record. 3
6. The petitioner sought for conducting of a proper survey and demarcating of the boundaries in terms of the title document of the petitioner. As seen from the impugned endorsement dated 23.07.2021, the 2nd respondent has perused the title documents of the petitioner. All that was expected of the 2nd respondent was to fix up the boundaries of the petitioner’s property in terms of the title documents. The petitioner, in order to fix the boundaries, sought a survey to be conducted.
The endorsement dated 23.07.2021 indicates that the petitioner is in possession of a lesser extent of land on the northern and southern sides when compared to the title documents. In such circumstances, it would have been appropriate on the part of the 2nd respondent to issue notice to the neighboring property owners and conduct a proper survey by issuing notices to all concerned neighboring property owners, and by verifying to their title documents, and demarcating the properties in accordance with the title documents. 7. Accordingly, the writ petition is disposed off, leaving it open to the petitioner to submit a fresh representation for conducting a detailed survey. The 2nd respondent shall issue notices to all concerned and complete the survey within a period of eight weeks from the date of receipt of the fresh representation from the petitioner. 8. Accordingly, the writ petition is disposed off. No costs. As a sequel, miscellaneous applications, pending, if any, shall stand closed. ____________________ JUSTICE HARINATH.N KGM
