JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by sole accused under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.494/2025 of HAL Police Station - 3 - HC-KAR NC: 2026:KHC:11347 CRL.P No. 15823 of 2025 registered for offences punishable under Sections 318(4) and 64 of Bharatiya Nyaya Sanhita, 2023. 2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. Learned counsel for petitioner would contend that, the petitioner and C.W.3 were friends and there is a relationship between the petitioner, C.W.3 and also with C.W.1. The said relationship is consensual. The victim lady is an Engineering graduate and she is aware of the consequences of her acts. On the alleged date of incident i.e., 16.07.2025, no room is booked in the lodge either by this petitioner or C.W.1 and C.W.3. On 18.07.2025, the room is booked in the hotel and the petitioner, C.W.1 and C.W.3 checked in at 04.30 a.m. There is a financial transactions between the petitioner, C.W.1 and C.W.3. The petitioner who stated to have received money from C.W.1 has sent it back to C.W.1. It is C.W.1 who has paid the - 4 - HC-KAR NC: 2026:KHC:11347 CRL.P No. 15823 of 2025 lodging charges and receipt has been issued in her name. The investigation is over and charge sheet has been filed. Therefore, the petitioner is not required for custodial interrogation. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. With these, he prayed to allow the petition. 4. Per contra, learned Additional State Public Prosecutor for respondent would contend that, the petitioner in the guise of getting job to C.W.1 took her to a lodge and had forcible sexual intercourse on her. The petitioner again had a sexual intercourse in the guise of taking the interview for the second time and had sexual intercourse. Thereafter, he promised C.W.1 to marry her and cheated her. The charge sheet materials show prima- facie case against the petitioner for offences alleged against him. Having heard the learned counsels appearing for parties, the Court has perused the charge sheet and other materials placed on record. 6. As per charge sheet, the case of the prosecution is that, the petitioner is a friend of C.W.3 and he asked her to give her laptop and as she was working in the laptop, she gave the laptop of C.W.1 and on using the said laptop he came to know that C.W.1 is in search of job. It is alleged that the petitioner in the guise of getting the job to C.W.1, took her to a lodge stating that she has to give interview on 16.07.2025 and had forcible sexual intercourse with her. Thereafter also, it is alleged that the petitioner stating that she has to give interview for the second round took her to the same lodge and had forcible sexual intercourse. Thereafter the petitioner stating that he will get her job with back door entry and for that she has to give money and got the money transferred to his bank account through phonepe and also taken her gold chain and laptop and has not returned the same. - 6 - HC-KAR NC: 2026:KHC:11347 CRL.P No. 15823 of 2025 7. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. The alleged relationship between the petitioner and the victim lady is consensual and are required to be ascertained at trial. The victim lady is an Engineering graduate and she is aware of the consequences of her acts. The petitioner is in judicial custody since 08.10.2025. As the charge sheet is filed, the petitioner is not required for further custodial interrogation. There are no criminal antecedents of the petitioner. 8. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following; ORDER The Criminal Petition is allowed. The petitioner is granted bail in Crime No.494/2025 of HAL Police Station, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees - 7 - HC-KAR NC: 2026:KHC:11347 CRL.P No. 15823 of 2025 One Lakh only) with one surety for the like-sum to the satisfaction of the Jurisdictional Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case.
