It is submitted that the petitioner/Lokayukta is before this Court questioning the order dated 07.02.2020 in Application No.6793/2018 (Annexure-A) passed by the Karnataka State Administrative Tribunal, Bengaluru, wherein the Tribunal has set aside the articles of charge and order dated 28.09.2017 bearing No.UPLOK- 1/DE/633/2017/A.Ni.V-7 and order of entrust bearing No.ToEi 28 ToSePa 2017 dated 26.04.2017 with liberty to the Government to initiate fresh action, if so advised. 3. However, the learned counsel appearing for the parties would bring to the notice of this Court that in pursuant to the said direction of the Tribunal, the State Government passed fresh order dated 18.03.2021 (produced along with affidavit dated 11.06.2026 by the petitioner/Lokayukta) entrusting the enquiry against respondent No.1 herein to the petitioner/Lokayukta. It is submitted that fresh enquiry was conducted and respondent No.1 herein was not found guilty. Accordingly, the State Government passed government order dated - 4 - HC-KAR NC: 2026:KHC:28640-DB WP No. 8639 of 2023 29.12.2023, exonerated respondent No.1. Therefore, it is submitted that the writ petition would not survive. Submissions of the learned counsel are placed on record.
