Order on Board 17.06.2026 1 The present writ petition has been filed by the petitioner ventilating a grievance that despite submission of an application dated 22.12.2020 before the competent revenue authorities seeking correction of revenue records, no final decision has been taken thereon till date. “I. The Hon'ble Court may kindly be please to issue the appropriate writ/orders by directing the respondents to make the correction in the Revenue record by considering the application of the petitioner dated 22/12/2020. II. The Hon'ble Court may kindly be please to issue the appropriate writ/orders by directing the respondents, to consider the application of petitioner, within stipulated time. III. The Hon'ble Court may kindly be please to call the records of the court's below. IV Any other relief which this Hon'ble Court deems fit and proper under the facts and circumstances of the case and in the interest of justice and cost of the petition may be awarded in favour of the petitioner.” 2
Learned counsel for the petitioner would submit that the petitioner is the recorded bhumiswami and possessor of land bearing Khasra No.331/1 admeasuring 0.178 hectare situated at Village Latera, P.H. No.17, Tehsil Palari, District Balodabazar-Bhatapara. It is further submitted that the petitioner also holds rights in land bearing Khasra No.202/2 admeasuring 0.056 hectare along with other co-sharers. According to the petitioner, although the aforesaid lands have neither been acquired by the Government nor subjected to any proceedings for acquisition, the revenue records incorrectly reflect them as having been affected by Samoda Diversion Project. It is contended that on account of the erroneous entries in the revenue records, the petitioner's registration for sale of paddy is not being accepted by the concerned authorities, despite the fact that the petitioner continues
3 to remain in possession of the lands and is carrying out agricultural operations thereon. It is further submitted that the petitioner
had,
therefore,
submitted
a
detailed representation/application on 22.12.2020 seeking correction of the revenue records and restoration of the petitioner's name in respect of the aforesaid lands. However, despite lapse of considerable time, the said application remains pending and undecided, causing serious prejudice and hardship to the petitioner. 3 On the other hand, learned State counsel, on instructions, submits that the petitioner's application dated 22.12.2020 could not be decided earlier as the Sub-Division, Palari was subsequently created and the application had initially been submitted before the Sub-Divisional Officer, Balodabazar. It is submitted that if the petitioner approaches the competent authority, namely the Sub- Divisional Officer, Palari, along with a copy of the application and supporting documents, the same shall be considered and decided expeditiously. Learned State counsel further submits that the petitioner's application can be decided within a period of 15 days. 4 I have heard learned counsel appearing for the parties and perused the material available on record. 5 Considering the limited grievance raised by the petitioner and without expressing any opinion on the merits of the claim, this Court deems it appropriate to dispose of the writ petition with a direction to the concerned Sub-Divisional Officer, Palari, District
4 Balodabazar-Bhatapara, to consider and decide the petitioner's application dated 22.12.2020, in accordance with law, preferably within a period of 15 days from the date of receipt of a certified copy of this order.
6 The petitioner is directed to appear before the Sub-Divisional Officer, Palari, along with a copy of the application dated 22.12.2020 and a certified copy of this order within a period of 07 days from today. 7 With the aforesaid observations and directions, the writ petition stands disposed of. 8 There shall be no order as to costs.
