In this writ petition, the petitioner is challenging the order dated 03rd June, 2024 (Annexure-K), wherein the respondent No.5 directed the institution of the petitioner to stop admission of students and to issue Transfer Certificates to the existing students; inter alia sought for direction to the respondent No.3 to consider the representation of the petitioner dated 10th June, 2024 (Annexure-L) and issue renewal recognition to the

institution namely Nandana Higher Primary School run by the petitioner.
2. Heard Sri. B.M. Hala Swamy, learned counsel appearing for the petitioner and Smt. B. Sukanya Baliga, learned Additional Government Advocate appearing for respondents.
3. Having taken note of the submission made by
learned counsel appearing for the parties and on perusal of the averments made in the writ petition, the same would indicate that the respondent No.5 had taken decision against the institution of the petitioner based on the complaint filed by the third party to the proceedings on the ground that the Managing Committee of the petitioner had provided fake documents and information to secure the recognition for the institution. In that view of the matter, I am of the view that the reasons assigned by the respondent No.5, directing the institution of the petitioner to stop admission of students and to issue Transfer Certificates to the existing students requires to be set-aside.
4. Under these circumstances, I am of the view that the respondent No.3 shall conduct a spot inspection of the

institution in question and thereafter take decision in the matter in terms of provisions contained under the Karnataka Education Act. Accordingly, I pass the following:
O R D E R (i) Writ Petition allowed; (ii)
Order dated 03rd June, 2024 (Annexure-K) passed by the respondent No.5 is hereby set- aside; (iii) The respondent No.3 is directed to consider the representation dated 10th June, 2024 (Annexure-L) and take decision in the matter for renewal of recognition, after conducting spot inspection of the institution in question in accordance with law, without there being influenced by any complaint filed by the third party, who is not connected with the affairs of the institution in question.
