JUSTICE S VISHWAJITH SHETTY ORAL ORDER Heard learned counsel for the petitioners and learned HCGP appearing on behalf of the respondent/State. 2. This petition under Section 483(1)(b) of Bharatiya Nagarik Suraksha Sanhita, 2023 is filed with a prayer to relax/modify condition No.2 imposed by the Court of IV Addl. District and Sessions Judge, Mysuru in - 3 - HC-KAR NC: 2026:KHC:29095 CRL.P No. 8109 of 2026 Crl.Misc.No.550/2026 disposed of on 27.04.2026, wherein, petitioners have been granted anticipatory bail in Crime No.115/2026 registered by K.R.Nagar Police Station, Mysuru District for the offences punishable under Sections 126(2), 351(2), 351(3), 352, 74, 115(2), 118(1), 119(1), 109, 133, 324(4), 324(5), 308(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023. 3. The material available on record would go to show that in respect of the alleged incident that had taken place on the intervening night of 20.03.2026 and 21.03.2026, a case and counter case has been registered by K.R. Nagar Police Station, Mysuru. 4. The petitioners herein are accused in Crime No.115/2026, whereas, based on the complaint filed on behalf of petitioners herein, FIR in Crime No.116/2026 was registered by the very same Police Station in which the complainant in the present case and her family members are arraigned as accused. It appears that there is some - 4 - HC-KAR NC: 2026:KHC:29095 CRL.P No. 8109 of 2026 property dispute between the parties and it is in this background the incident in question had taken place. 5. Learned Sessions Judge having appreciated the aforesaid aspects of the matter has granted anticipatory bail to the petitioners herein, who are arraigned as accused in Crime No.115/2026 registered by K.R. Nagar Police Station, Mysuru, subject to certain conditions. 6. The condition No.2 imposed by the learned Sessions Judge while granting anticipatory bail to the petitioners herein in Crl.Misc.No.550/2026, which was allowed on 27.04.2026 reads as follows:- "2. The petitioners shall mark their attendance before the I.O every day in between 10.00 a.m., to 6.00 p.m., till filing of charge sheet or till further orders which ever is earlier." The petitioners are before this Court seeking modification/relaxation of the aforesaid condition no.2. - 5 - HC-KAR NC: 2026:KHC:29095 CRL.P No. 8109 of 2026 7. Learned counsel for the petitioners submits that the aforesaid condition no.2 has been causing untold hardship to the petitioners who are agriculturalists by avocation and do not have any criminal antecedents. 8. Learned HCGP appearing on behalf of respondent/State does not seriously oppose the prayer made in the petition to relax/modify condition no.2. 9. Undisputedly, the petitioners herein are persons without criminal antecedents and the alleged incident had taken place in the background of dispute between the parties and it appears that both the parties have suffered injuries in the said incident and a case and counter case has been registered in Crime Nos.115 and 116 of 2026. 10. Under the circumstances, the learned Sessions Judge was not justified in imposing condition no.2 on the petitioners herein. Therefore, I am of the opinion that the prayer made by the petitioners in this petition needs to be granted. Accordingly, the following: - 6 - HC-KAR NC: 2026:KHC:29095 CRL.P No. 8109 of 2026 ORDER (i) The petition is allowed. (ii) The condition No.2 imposed by the Court of IV Addl. District and Sessions Judge, Mysuru in Crl.Misc.No.550/2026 disposed of on 27.04.2026 stands relaxed. (iii) All other conditions imposed by the Court of IV Addl.
