ORDER This Writ Petition has been filed to direct the 1st respondent to cancel the patta No.3960 standing in the name of Aruna and thereafter issue patta in the name of the petitioner in the light of the order dated 30.11.2023 passed by this Court in W.P.No.24487 of 2017.
2. Mr.R.P.Murugan Raja, learned Government Advocate, accepts notice on behalf of the respondents 1 and 2. Since no adverse order is passed against the 3rd respondent in this writ petition, notice to the 3rd respondent is dispensed with by this Court.
3. It is represented by the learned Government Advocate appearing for the respondents 1 and 2 as well as by the learned counsel for the petitioner that pursuant to the representation of the petitioner, the 2nd respondent has already conducted enquiry on the said representation Page No.2 of 6 https://www.mhc.tn.gov.in/judis
W.P.No.14408 of 2026 by issuing notice to the 3rd respondent. But, despite the same, the 3rd respondent chose not to appear before the 1st respondent and therefore, a direction may be issued to the 1st respondent, the competent authority, to pass final orders on the petitioner’s representation seeking cancellation of patta No.3960 standing in the name of the 3rd respondent, within a time frame to be fixed by this Court.

Since the representation of the petitioner has already been acted upon by the 2nd respondent and an enquiry has also been conducted by the 2nd respondent, no prejudice would be caused to the respondents, if a direction is issued to the 1st respondent to pass final orders on merits and in accordance with law on the petitioner’s representation, dated 20.01.2025 seeking cancellation of patta No.3960 standing in the name of the 3rd respondent, within a time frame to be fixed by this Court.

6. For the foregoing reasons, this Court directs the 1st respondent to pass final orders, on merits and in accordance with law, on the petitioner’s representation, dated 20.01.2025 seeking cancellation of patta No.3960 standing in the name of the 3rd respondent, after giving due
consideration to the order dated 30.11.2023 passed by this Court in W.P.No.24487 of 2017 as well as the supporting documents produced by the petitioner and after hearing the objections of all the necessary parties, which includes the 3rd respondent, whom the 1st respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
