The petitioner named above has been made accused in connection with Karmatar P.S. Case No. 89 of 2025 for the offences registered under Sections 64(1), 64(2)(m) of the Bhartiya Nyaya Sanhita, 2023 and Section 6 of POCSO Act, pending in the court of learned Special Judge, POCSO Act, Jamtara. The informant is the father of the victim girl, aged 17 years and 10 months, who was student of Class-XI, whereas the petitioner is aged 26 years. It is alleged that on a false promise of marriage, the victim girl was sexually exploited by the petitioner. It is submitted by learned counsel for the petitioner that there was love affairs between the petitioner and the victim girl. The petitioner is ready and willing to marry the victim girl. The petitioner is a young boy and he has no criminal antecedent. Learned counsel for the State has opposed the prayer for bail and submitted that the age of the victim girl is immaterial. Leaned counsel for the informant submits that the informant will have no objection for grant of bail to the petitioner if he is ready to marry the victim girl. Considering the aforesaid facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail 2026:JHHC:3529 2 bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
