ORDER:
The instant Writ Petition has been preferred challenging the high- handedness of respondent Nos. 4 and 5, who are alleged to have threatened the petitioner with dispossession from the property. 2. Written instructions have been submitted by the learned Assistant Government Pleader for Home, contending inter alia that since the said issue is pending before Civil Court, the police will not interfere in the matter. It appears from the instructions that respondent No. 4 has only advised the petitioner not to disturb law and order of locality. However, the instructions do not refer to the dispute raised by the petitioner. For the reasons stated therein, the same appears to be correct. 3. Thus, I make it clear that the police authorities cannot compel any person to approach any Court, including a civil court, for settlement of disputes, and shall only to ensure that law and order in the locality may not be disturbed. 4. Considering the same, the written instructions of the Home Department are taken on record. The police authorities are directed not to harass the petitioners herein in respect of their possession, unless and until there is a specific order passed by a competent court. 5
Accordingly, the instant Writ Petition is disposed of. There is no order as to costs. Consequently, pending miscellaneous applications, if any, shall stand closed. __________________________ JUSTICE SUBHENDU SAMANTA
