Respondent(s) For Petitioner(s) : Mr. Ratnesh Kumar Agrawal, Advocate. For Respondent(s)/State : Mr. Shobhit Mishra, Dy. G.A. Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 16/06/2026 1. By way of this petition, the petitioner has prayed for following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for entire records of the case, from the authorities. 10.2 That, this Hon'ble Court may kindly be please to quash the order dated 07.05.2026 passed by respondent no. 2 (Annexure-P/1) and further be please to direct to respondent no. 2 to Rehabilitate to the petitioners is in the interest of justice. 3 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.” 2. Learned counsel appearing for the State submits that the present writ petition is premature, as the land acquisition proceedings have not yet attained finality. It is contended that the acquisition proceedings are still pending and no award has been passed by the competent authority till date. Therefore, unless and until the acquisition proceedings are duly concluded and an award is passed in accordance with law, the question of undertaking any process of re-settlement does not arise. It is further submitted that the petitioner's claim for re-settlement can only be considered after the completion of the acquisition proceedings and the passing of the award, and as such, the present petition deserves to be rejected as being premature. 3. Learned counsel for the petitioner after arguing for some time seeks permission of this Court to withdraw this petition with liberty to file same at appropriate stage. 4. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty. Sd/- (Amitendra Kishore Prasad) Judge Raghu Jat
