Page No.# 2/2 By this application filed under Section 528 of the BNSS, 2023 the petitioner, namely, Sahil Ali Ahmed, has challenged the order dated 05.03.2022 passed by the learned Chief Judicial Magistrate, Dibrugarh in NI Case No. 207/2025 issuing Warrant of Arrest against the petitioner and earlier similar orders dated 21.01.2026 and 10.02.2026 passed in the said NI case. On one occasion, the petitioner could not appear before the learned Trial Court and therefore Warrant of Arrest has been issued against him. I have considered the submissions made by the learned counsel for both sides. In the light of the materials available in the record, this Court is of the opinion that, one opportunity should be given to the petitioner to contest the trial as he is interested in facing the same. Therefore, the prayer of the petitioner is allowed. Hence, the order dated 05.03.2022 passed by the learned Chief Judicial Magistrate, Dibrugarh in NI Case No. 207/2025 issuing Warrant of Arrest against the petitioner and earlier similar orders dated 21.01.2026 and 10.02.2026 passed in the said NI case are set aside and quashed. The petitioner Sahil Ali Ahmed is directed to appear before the learned Chief Judicial Magistrate, Dibrugarh in connection with NI Case No. 207/2025 on 18.03.2026. On his appearance, the learned Chief Judicial Magistrate, Dibrugarh shall allow the petitioner to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Trial Court.
