Accused in S.C.No.6/2026 pending before the Court of II Additional District and Sessions Judge, Mysuru, arising out of Crime No.88/2025 registered by the Vidyaranyapuram Police Station, Mysuru, for offence punishable under Section 109 of the Bharatiya Nyaya Sanhita (BNS), 2023 (hereinafter referred to as 'BNS, 2023' for short), is before this Court in this criminal petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. - 3 - HC-KAR NC: 2026:KHC:28807 CRL.P No. 4408 of 2026 2. Heard the learned counsel appearing for the petitioner and learned Addl. SPP appearing for the respondent-State. 3. FIR in Crime No.88/2025 is registered by the Vidyaranayapuram Police Station, Mysuru, against the petitioner for offence punishable under Section 109 of BNS, 2023 based on the first information dated 28.10.2025 received from R.Krishna, father of injured Sanjay.K. During the course of investigation, the petitioner was arrested on 28.10.2025 and was remanded to judicial custody. After completing investigation, charge sheet has been filed against the petitioner for the aforesaid offence. The bail petition of the petitioner filed before the jurisdictional Sessions Court in S.C.No.6/2026 was rejected on 06.02.2026. Therefore, he is before this Court. 4. Perusal of material on record would go to show that the petitioner and the injured victim were acquainted with each other. Petitioner allegedly used to demand money - 4 - HC-KAR NC: 2026:KHC:28807 CRL.P No. 4408 of 2026 from the victim for consuming alcohol. On 27.10.2025, at about 8.15 p.m., petitioner allegedly demanded money from the victim for consuming alcohol. When he refused to pay the money, petitioner allegedly had quarreled with him. CW-3 to CW-5 had pacified and advised him. In this background, at about 08.30 p.m. on 27.10.2025, the petitioner allegedly assaulted the victim, Sanjay with a knife and caused injuries. Sanjay, who was admitted to the hospital, has been discharged from the hospital on 11.11.2025. Undisputedly, his condition is stable. 5. It is not in dispute that the petitioner has no other criminal antecedents. He is in custody in the present case from 28.10.2025. Investigation of the case has been completed and charge sheet has been field. The trial in the case is yet to commence. 6. Under the circumstances, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. The petitioner is directed to be enlarged on bail in S.C.No.6/2026 pending before the Court of II Additional District and Sessions Judge, Mysuru, arising out of Crime No.88/2025 registered by the Vidyaranyapuram Police Station, Mysuru, for offence punishable under Section 109 of the Bharatiya Nyaya Sanhita (BNS), 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR NC: 2026:KHC:28807 CRL.P No. 4408 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
