( 2026:JHHC:21603 ) -2- A.B.A. No. 2674 of 2026 With A.B.A. No. 3059 of 2026 4. Learned counsel appearing for the petitioners submits that in A.B.A. No.2674 of 2026, petitioner no.1 was employed as Head Debt Management- Commercial Finance, Tata Capital Limited (erstwhile known as Tata Capital Financial Services Limited) and petitioner no.2 is employed as Manager Collections, Personal Loans, Tata Capital Limited and the petitioner in A.B.A. No.3059 of 2026 was employed as Regional Collection Manager- Commercial Finance in erstwhile Tata Capital Financial Services Limited. He further submits that all the officials of the said company have been falsely implicated in the case. He then submits that initially private complaint case was filed, which was subsequently converted into FIR pursuant to the order of the learned Court. He next submits that the present case has been lodged only to prevent the said company from exercising its contractual rights under the loan cum hypothecation cum guarantee agreement and recover its huge sum of amount under statutory rights under SARFAESI Act and execution of decree under arbitral award which is due and payable from the informant, including the borrower and all guarantors. He also submits that the petitioners have replied to the notice under Section 41-A of Cr.P.C. and it has come in para 22 of the case diary. He further submits that the petitioners are responsible citizen and they will cooperate in the investigation. He next submits that only because the articles have been seized by the said company pursuant to the order passed by the Deputy Commissioner in light of SARFAESI Act, false case has been registered against the petitioners. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners. 5. Learned counsel appearing for the State in respective cases ( 2026:JHHC:21603 ) -3- A.B.A. No. 2674 of 2026 With A.B.A. No. 3059 of 2026 opposed the prayer and submit that the allegations are made of taking signature on plain paper and, thereafter, new document has been created and in view of that, the prayer for anticipatory bail may kindly be rejected. 6. Considering that in A.B.A. No.3059 of 2026 was employed as Regional Collection Manager-Commercial Finance in erstwhile Tata Capital Financial Services Limited and admittedly the informant has taken loan from the said company and he has failed to pay EMIs and, thereafter, the company has gone for recovery and the matter has escalated up to the Deputy Commissioner and pursuant to the order of the Deputy Commissioner, the article has been seized and prima facie, it appears that the complaint case was intentionally filed to implicate the officials of the company falsely and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 7. Accordingly, the above-named petitioners in both the applications are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Ranchi in connection with Chutia P.S.
