1. Heard Mr. Dinesh Kumar, learned counsel for the applicants and learned A.G.A. representing the State and perused the record.
2. The instant application has been preferred by the applicants with a prayer for expeditious disposal of Case No. 122 of 2020 (Sakshi and another Versus State of U.P. and another), under Section 125 Cr.P.C., Police Station Mahawan, District Mathura, pending in the court of Ld. Principal Judge, Family Court, Mathura, within stipulated time.
3. Learned counsel for the applicants apprised this Court that a petition under Section 125 Cr.P.C. is pending since 2020 before the concerned trial court and the case has not culminated to its logical conclusion.
4. Learned A.G.A. states that no useful purpose would be served in issuing notice to opposite party No. 2 and keeping this application pending before this Court and he has no objection if the matter be expedited in the interest of justice.
5. In view of the above, it is directed that the learned trial court concerned shall make all endeavour to decide the case Versus Counsel for Applicant(s) : Dinesh Kumar, Suresh Kumar Srivastava Counsel for Opposite Party(s) : G.A. Smt Sakshi And Another .....Applicant(s) State of U.P. and Another .....Opposite Party(s)
expeditiously preferably within a period of six months from the date of production of certified copy of this order, if there is no legal impediment, without granting unnecessary adjournments to either of the parties.
