Respondent(s) For Petitioner : Mr. Shikhar Sharma, Advocate For Respondents No. 1 to 3 : Mr. Pankaj Agrawal, Advocate For Respondent No. 5 : Mr. Raj Kumar Gupta, Advocate Digitally signed by AJINKYA PANSARE Date: 2026.06.17 16:58:37 +0530 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 17.6.2026 1) By way of this petition, the petitioner has sought following reliefs:- 10.1 That, this Hon'ble Court may kindly be pleased to quash the impugned order dated 19-03-2018 (Annexure P-1) passed by the respondent No.2. 10.2 That, this Hon'ble Court be pleased to pass an order directing the respondent to grant family pension to the petitioner from date of her application i.e. 05-11-2009 in terms of memorandum dated 06-09-2007 and 28-04-2011 (Annexure P-2) at the earliest. 10.3 That, the Hon'ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate. 2) Facts of present case are that petitioner’s father namely Sakha Ram was working on the post of Lower Division Clerk under South Eastern Coalfields Limited (SECL). He died on 19.10.2000 and after his death, petitioner’s mother also passed away on 23.8.2002. In this petition, petitioner who is the 48 years old unmarried daughter of deceased SECL employee is claiming family pension placing reliance on a office memorandum issued by Ministry of Personnel, Government of India dated 6.9.2007. 3) Learned counsel appearing for the respective respondents vehemently argue that the office memorandum dated 6.9.2007 pertains to extension of scope of family pension to unmarried daughters of central government servants/ pensioners whereas petitioner’s father was an employee of SECL and he cannot be 3 termed as a central government servant. They submit that instant writ petition is misconceived and liable to be dismissed. 4) Heard. 5) Admittedly, petitioner who is the unmarried daughter of a deceased SECL employee is claiming family pension taking refuge of an office memorandum issued by the Department of Personnel, Government of India dated 6.9.2007. However, this office memorandum clearly speaks that it applies to the unmarried daughters of central government servants/ pensioners only. Therefore, in my opinion, petitioner would not get any benefit from the said office memorandum. 6) Consequently, this petition fails and is hereby dismissed.
