The MCC has been filed for restoration of Second Appeal No. 675/2019, which was dismissed for want of prosecution by this Court vide order dated 16.04.2026. 2. Learned counsel for the petitioner submits that the appeal was dismissed for want of instructions as the petitioner could not be contacted after shifting his residence and changing his mobile number. The petitioner was unaware of the proceedings and came to know about the dismissal only subsequently, thereafter he promptly approached the counsel. It is submitted that the default was neither intentional nor due to negligence, but occurred on account of bona fide reasons. Hence, restoration of SA No. 675/2019 is prayed for in the interest of justice. 3. On due consideration and for the reasons assigned therein, which is duly supported by an affidavit, this Court is satisfied that sufficient cause has been shown for restoration of Second Appeal No. 675/2019 4. Accordingly, this MCC is allowed. Registry is directed to restore Second Appeal No. 675/2019, to its original number subject to 4 payment of costs of Rs. 2,000/- payable to the High Court Legal Aid Committee.
