Case No. 17 of 2025 corresponding to Special POCSO Case No.16 of 2025 for the offence registered under Sections 137(2), 96 of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Additional Sessions Judge II-cum- Special Judge, POCSO Act Cases, West Singhbhum at Chaibasa, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that he is aged 21 years, whereas the victim girl as per the medico-legal examination report, is 15 – 16 years. It is further submitted that the statement of the victim was recorded under Section 183 of the BNSS, wherein she has stated that she had gone along with the petitioner on her own sweet will and there was no inducement on his part. It has also been stated that she wanted to marry the petitioner. Learned A.P.P. opposed the bail petition. It is submitted that the victim is minor and her consent is immaterial. Under the aforesaid facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
