By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.06.17 14:48:52 +0530 2 10.2 That, this Hon'ble Court may kindly be pleased to set-aside/quash the impugned order dated 27.10.2022 (ANNEXURE P-1) passed by the respondent no. 4. 10.3 That, the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondent authorities to allow the petitioner to continue in service as peon in the office of Collector - Koriya (C.G.) and she may be paid regularly the salary for her aforesaid work. 10.4 Cost of the petition. 10.5 Any other relief may also be granted to the petitioner, which this Hon'ble Court feels fit according to facts and circumstances of the case.” 2. Facts in brief are that the petitioner, who is permanent resident of Jaisinghnagar, District Shahdol, M.P. applied for post of Peon in a special drive launched for Particularly Vulnerable Tribal Groups(PVTG) for appointment to the Class-III and Class-IV posts pursuant to letter dated 27.06.2022. The petitioner submitted her application and she was selected and subsequently, order of appointment was issued in her favour on 08.08.2022 and she was posted in the office of Collector, Koriya. During scrutiny of documents, it was found that the petitioner is permanent resident of State of Madhya Pradesh, and social status certificate was issued in her favour by Sub-Divisional Officer (Revenue), Jaisinghnagar, District Shahdol, thus, she was not entitled to get benefit of reservation in the State of Chhattisgarh, therefore, the office of respondent No. 4 cancelled the order of appointment of the petitioner vide order dated 27.10.2022 and against said order this petition has been preferred. 3. Learned counsel for the petitioner would argue that the petitioner submitted all relevant documents including social status certificate and after due 3 scrutiny, she was selected and order of appointment was issued. He would contend that the said order was executed as petitioner joined the services on the post of Peon. It is also argued that without affording any opportunity of hearing the order of appointment was cancelled by the office of Collector, Koriya vide order dated 27.10.2022. It is submitted that the said order was passed in violation of principle of natural justice, therefore, same may be quashed and direction may be issued to the respondents to reinstate the petitioner in service with backwages. 4. On the other hand, learned counsel appearing for the State would oppose. Mr. Saini, Dy. G.A. appearing for the State would contend that the petitioner is not a resident of State of Chhatisgarh. It is argued that in special drive for PVTG, applications were invited for Class-III and Class-IV posts. He would submit that the petitioner was called for document verification and during course of scrutiny, it was found that petitioner is not a permanent resident of State of Chhattisgarh, and subsequently, order of cancellation of appointment was issued. He would submit that social status certificate in favour of the petitioner was issued by the Sub-Divisional Officer (Revenue), Jaisinghnagar, District Shahdol. He would submit that this petition is misconceived and deserves to be dismissed. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. The petitioner participated in the recruitment process pursuant to memo issued by the office of Collector, Koriya. The said recruitment process was launched for Particularly Vulnerable Tribal Groups of State of Chhattisgarh. Though the petitioner is a member of Particularly Vulnerable Tribal Group, 4 but her social status certificate was issued by the office of Sub-Divisional Officer, Jaisinghnagar, District Shahdol, and thus, she was not entitled to get benefit of said certificate in the State of Chhattisgarh. During course of scrutiny of the documents, this fact was detected, and immediately thereafter, order of cancellation of appointment was issued. It is well settled principle of law that the benefit of reservation can be availed in the State where a person has been born. 7. Taking into consideration the above-discussed facts, I do not find any good ground to interfere with the order Annexure P/1 dated 27.10.2022. Accordingly, this petition fails and is hereby dismissed.
