ORAL ORDER
1. The Petitioner is before this Court seeking for the following reliefs: a) Issue A writ in the nature of writ of certiorari by setting aside the impugned communications dated 02.12.2025 issued by the 2nd Respondent Bank (Annexure-B) as being illegal and void;
b) Issue a writ of mandamus directing Respondent Nos.1 and 2 to forthwith release the amount of Rs.16,00,793/- standing to the credit of Account No. 74210100003520 of Late Miss L. Saroja, in favour of the Petitioner, being the duly recorded nominee and to recognize the Petitioner as the valid and subsisting nominee of Late Miss L. Saroja for all purposes;
c) Issue a direction to the 3rd respondent to return back the original documents of the property and jewellery of late Smt. Saroja, forthwith to the Petitioner

d) Grant such other order/s or direction/s as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice and equity.
2. The Petitioner claims to be the nominee in respect of a bank account maintained by one Smt. L. Saroja with respondent No.2-Bank. It is submitted that though Smt. Pramila had originally been nominated in relation to the said account; the nomination was subsequently altered by Smt. L. Saroja and Smt. Manjula N. came to be nominated. Thereafter, Smt. L. Saroja is stated to have once again changed the nomination and nominated the present Petitioner as the nominee in respect of the said account.
3. Upon the demise of Smt. L. Saroja, the Petitioner approached the respondent-Bank seeking release of the amounts lying to the credit of the said account. The request, however, was not acted upon on the ground that there were multiple nominations reflected in the records and, therefore, the amount could not be released in favour of the Petitioner.
4. Notice having been issued, the respondents have entered appearance through counsel.

Learned counsel appearing for respondent No.1 submits that the Bank has no objection to considering the Petitioner's request for release of the amounts lying to the credit of the account, the Petitioner being reflected as the latest nominee in the records of the Bank, subject to the Petitioner complying with the procedural requirements of the Bank, including furnishing such affidavits, declarations, indemnities and other documents as may be required in accordance with the applicable rules and regulations.
6. The aforesaid submission of the learned counsel for respondent No.1 substantially redresses the grievance of the Petitioner. In view thereof, no further adjudication is required in the present proceedings.
7. Accordingly, liberty is reserved to the Petitioner to approach the respondent-Bank and comply with all requisite formalities and documentation as may be prescribed. Upon such compliance, the respondent- Bank shall process the Petitioner's request and release the amount, if otherwise found eligible, in accordance with law and the applicable banking regulations, as expeditiously as possible and in any

event within a period of four weeks from the date of completion of all formalities by the Petitioner.
8. With the above observations and directions, the writ petition stands disposed of. No order as to costs.
