Learned counsel for the petitioner submits that the petitioner is in custody in connection with Sariya P.S. Case No. 203 of 2025 corresponding to POCSO Case No. 7 of 2026 for the offence registered under Sections 376(2)(n)/313 of IPC and Sections 4/6/8 of POCSO Act, now said to have been pending in the court of learned Special Judge POCSO-cum-District Judge-VIII, Giridih. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner happens to be the neighbour of the victim. It is not in dispute that the victim was around 16 years of age. 3. Learned counsel for the opposite party has opposed the prayer for bail and has submitted that there is directed allegation against the petitioner. 4. After hearing the learned counsel for the parties and upon going through the statement of the victim recorded under Section 183 of BNSS, wherein she has stated that she used to visit the house of the petitioner to watch television and that, on one day, the petitioner wrongfully confined her inside the house and forcibly committed rape upon her, this Court is 2026:JHHC:21589 2 not inclined to enlarge the petitioner on bail.
