JUSTICE PARTHIVJYOTI SAIKIA O R D E R 03.02.2026 Heard Mr. H.R. Choudhury, the learned counsel appearing for the petitioner. Also heard Mr. K.K. Parasar, the learned Addl. Public Prosecutor, Assam. 2. This is an application under Section 483 of the BNSS, 2023 in respect of Special Sessions (POCSO) Case No.162/2023 (arising out of Badarpur P.S. Case No.137/2023). 3. The petitioner Asad Uddin Laskar @ Asab Uddin Laskar has been shown as an absconder in the charge sheet. Therefore, the trial court had directed to issue Non- bailable Warrant of Arrest against him and he was accordingly arrested by police and remanded to custody. 4. The petitioner submits that his lawyer did not inform him about the date of appearance and that is the reason why he could not appear before the trial court on the fixed date. 5. It may be mentioned that during the period of investigation, the petitioner was granted anticipatory bail by this Court. 6. Considering all these circumstances, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. His bail application is allowed. 7. The petitioner Asad Uddin Laskar @ Asab Uddin Laskar who is facing trial in Special Sessions (POCSO) Case No.162/2023 (arising out of Badarpur P.S. Case No.137/2023) shall be released on bail of ₹25,000/- with a surety of like amount to Page No.# 3/3 the satisfaction of learned Addl. Sessions Judge, Sribhumi. 8. It is directed that the aforementioned petitioner shall regularly appear before the trial court. If he fails to do so, the trial court/competent court shall have the liberty to procure his attendance by following due process of law. With the above direction, the bail application is disposed of.
