This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of ABA No. 2178 of 2025 to its original file. Learned counsel for the petitioner submits that the ABA No. 2178 of 2025 was rejected as not pressed vide order dated 08.04.2025 and then vide order dated 19.12.2025 passed in CrMP No. 2950 of 2025, ABA No. 2178 of 2025 was restored subject to filing of proof of payment of cost of Rs. 10,000/- by the petitioner to the opp. Party no. 2 through his counsel appearing in the record with two weeks but due to inadvertence the same could not be complied in time. Learned counsel for the petitioners submits that the said cost has already been paid to the opp. Party no. 2 through his counsel appearing in the record. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that ABA No. 2178 of 2025 be restored to its original file. Learned Addl. P.P. and the learned counsel for the opposite party no.2 have no serious objection to the prayer of restoration. Considering the aforesaid submission of the learned counsel for the petitioner, ABA No. 2178 of 2025 is restored to its original file to the stage, at which, it was before its dismissal.
