This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.608/2026 registered at Police Station – Sarkanda, District-Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 351(2), 118(2), 3(5) of Bhartiya Nyay Sanhita, 2023. Case of the prosecution, in brief, is that on 01.05.2026, the complainant Ravi Kumar Soni lodged an oral report at Police Station, Sarkanda, alleging therein that his son Anubhav Soni used to play Cricket and he was selected for University Cricket Team, due to which, the Team Captain namely Raj Pali was having grudge against the son of complainant namely Anubhav Soni. On 01.05.2026 Raj Pali called to Anubhav Soni near R.S.K. Academy, Mahamaya Sarkanda and Anubhav Soni reached there at about where the accused Raj Pali and Rishu Thakur abused to Anubhav Soni with filthy language, which was objected by him, upon which, Raj Pali has assaulted him with the help of clipper (Kaichi), due to which, Anubhav Soni has received injuries near his eye & neck and he has been admitted in Pratham Hospital for treatment. 3. Learned counsel for the applicant submitted that one of the co-accused Raj Pali who had called the injured on the place of occurrence and he assaulted the injured with a scissor and the applicant though had used some abusive language but was not aware of the fact that the co- accused Raj Pali was having a scissor who assaulted the injured. He would submit that the applicant had not caused any injury to the injured and he is a student. He would submit that the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by this Court, applicant is a permanent resident of address mentioned in the cause title and there is no chance of his absconding, therefore he prays to enlarge the applicant on anticipatory bail. 3 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation levelled against the applicant, further the fact that applicant had not caused any injury to the injured and he is a student and also considering the fact that investigation and trial are likely to take some time, therefore I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Prashant Singh @ Rishu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. 4 (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
