2. Unsuccessful plaintiffs with regard to item Nos.1 to 19 in O.S.No.191/2018 are appellants in the second appeal.

Facts of the case which are utmost necessary for disposal of the present appeal are as under:
4. There is no dispute among the relationship of the parties as is prescribed in the plaint. 5. 6. Suit on contest came to be dismissed on the ground that without the cancellation of registered partition deed, oral partition is impermissible. 7. Being aggrieved by the same, plaintiffs filed an appeal before the First Appellate Court in R.A.No.52/2023. 8. Learned Judge in the First Appellate Court after securing the records heard the arguments of the parties and noted that in the registered partition deed dated 08.02.2018 item No.20 of the suit property was left out and therefore, allowed the appeal in part granting 1/9th share to the plaintiffs in item No.20 of the suit properties and dismissed the appeal insofar as the other reliefs are concerned. 9. Being further aggrieved by the same, it is the plaintiffs who have approached this Court in this second appeal on the following grounds:

That the judgment and decree passed by the Courts below are highly illegal, arbitrary, unreasonable and unsustainable under law. It is submitted that the Courts below have committed serious material irregularities and illegalities while appreciating the material evidence available on record and the entire approach made by the Courts below into the matter in dispute is erroneous in law.
At the outset, it is to be noticed that Ex. P1 partition deed dated 08.02.2018 registered on 09.02.2018 before the Registrar. That the Ex.P2 to P8, which are garniary with houses are not part of the partition deed dated 08.02.2018 registered on 09.02.2018. Very astonishing incidents taken place. On the same day, a unregistered Jubani partition was entered between the parties which in fact produced before the Court and the same is not marked. That the Courts below erred in not considering the conspicuous incident when on the one hand the registration of partition deed taken place on 09.02.2018 and on what circumstances Ex.P2 to P8 properties are not included in the partition deed thereby Suspicious prompting to enter a jubani partition. Suspicious circumstances and conspiracy not ruled out and the Courts below failed to note this aspect, much less that the defendant No.1 at para 6 of his evidence states that the said Jubani parikath dated 09.02.2018 is bogus. Therefore, it manifest that these item properties are not part of the partition deed at Ex.P1 nor does he do not deny such properties Ex.P2 to P8 are not part of partition deed

dated 8.2.2018 registered on 09.02.2018 nor does it belongs to the family of the plaintiffs and defendants. It is submitted that the defendants have not denied the relationship of the plaintiffs and defendants. The defendants have also admitted that the 1st appellant was the 2nd wife of original propositus one Late Patil Nagendrappa and the appellant Nos.2 and 3 are his daughters through the 1st appellant. They have also admitted that they are the children of original propositus Late Patil Nagendrappa through his first wife Dyamamma. Therefore, it is clear that the plaintiff No.2 & 3 and defendant No.1 to 6 are the children of Late Nagendrappa. It is submitted that the defendants have not disputed that Patil Nagendrappa was the owner of the suit schedule properties and after the death of Patil Nagendrappa, the plaintiffs and defendants have continued and constituted a joint family and enjoying the suit schedule properties jointly.
Therefore, the plaintiffs and defendants are coparceners and are entitled for equal share. It is submitted that the defendants have also not disputed that after the death of Patil Nagendrappa there were differences of opinion between the appellants and the respondents. It is relevant to submit here that the defendant No.1 to 6 have expressed their opinion of partition and separate possession. Though the plaintiffs have consented for the partition and separate possession, in spite of it, the defendants have played fraud on the plaintiffs. - 17 -

That admission of the D.W.2 speaks about the complaint given to police regarding forgery of the documents. This manifest that plaintiffs have taken the initiative to file the complaint and the same is not registered by PW 5 Inspector who totally denied filing of complaint. A probable steps taken by the complainant to register the complaint. The Courts below failed to notice, the share of the property is not equally divided and these are extracted in the
judgment it establish the share in the manner lamb and lion. It is submitted that though the defendants have agreed to give share to the plaintiffs as per the advice of the panchayathdars, later on 08.02.2018 the defendants by saying that they shall go to Harihara Lingeshwara Temple, took the plaintiffs in the van along with the husband of plaintiff No.3 to Sub- Registrar office, Davanagere and by giving life threat forcibly obtained their signatures and further on 09.02.2018 the defendants have also forcibly obtained signatures of plaintiffs on jubani partition deed and the defendants have effected the partition as per their convenience and the plaintiffs have not admitted the partition deed and the Jubani partition deed. Therefore, the above partition deed effected is not in accordance with equal share to the plaintiffs and the plaintiffs have protested for the same, however, the panchayathdars have advised that they will settle matter and will give equal share to the plaintiffs, they have not filed any complaint, but the

panchayathdars have not convened any panchayath and therefore on 10.10.2018 the plaintiffs filed the complaint before Davanagere Rural Police and since the police have not taken any action, the present suit filed for partition and separate possession and cancellation of partition and jubani partition deed. It is submitted that on perusal of the registered partition deed it is clear that the defendants have not included all the family properties in the said partition deed. Further more, the defendants have played fraud on the plaintiffs. When the plaintiffs are also entitled for equal share, but partition deed said to be entered into between the plaintiffs and defendants, there are no equal shares allotted to the plaintiffs. Hence, the said partition deed is fraud and obtained the signatures of the plaintiffs by giving life threat. It is submitted that all the joint family properties are not included in the partition deed and the plaintiffs have not given proper share in all the suit schedule properties.
The plaintiffs during the course of recording evidence, came to know that the defendants purposefully have not included other properties in the partition and though the plaintiffs brought to the notice of the Hon'ble Courts below for bringing those properties, but the Courts have not permitted the plaintiffs for bringing those properties in the suit for partition and therefore the entire judgment and decree passed by the trial Court become nullity. It is submitted that the plaintiffs have also produced several documents in respect of other properties

which are joint family properties, but the Courts below have not provided any opportunity and also not looked into those documents and erroneously dismissed the suit. That the Court has concluded while deciding issue No.4. Several item of properties/ house properties and garnere properties not part of the suit schedule. In that circumstances, it ought to have concluded or given any opportunity to file fresh suit by incorporating all the properties. In fact it is not the case of the defendant for want of non inclusion of the properties suit liable to be dismissed. It is submitted that the plaintiffs have proved the fraud played by the defendants on the plaintiffs, in spite of it, the Courts below have not considered the same and erroneously dismissed the suit. It is submitted that the plaintiffs are entitled for equal share in all the suit schedule properties since they are the co-parceners. However, the defendants have not allotted equal share to the plaintiffs. Therefore, the Courts ought to have decreed the suit by directing the defendants for fresh partition and allot equal share to the plaintiffs. 10.
Sri Hareesh Bhandary T, learned counsel for the appellants reiterating the grounds urged in the appeal memorandum contended that the dismissal of the suit of the plaintiffs by the Trial Judge and confirmed by First Appellate Court insofar as item Nos.1 to 19 of the suit properties has

resulted in miscarriage of justice inasmuch as there is no partition in all the properties. Moreover, all properties of joint family are not included in the partition deed even if it is a registered and therefore declaratory relief as sought for by the plaintiffs ought to have been granted and sought for admitting the appeal. 11.
Learned counsel for the appellants sought to admit the appeal on the following substantial questions of law. 1) Whether the Courts below have committed serious material irregularity and illegality while appreciating the material evidence available on record? 2) Whether the Courts below have erred in not considering that the defendants have played fraud on the plaintiffs in getting their signatures to the partition deed by giving life threat to them? 3) Whether the Courts below have erred in not granting equal share to the plaintiffs in the registered partition deed though the plaintiffs are the coparceners? 4) Whether the Courts below has erred in not considering that the admissions made by DWs 1 to 3 in their evidence ? - 21 -

5) Whether the lower Appellate Court is justified in confirming the judgment and decree passed by the trial Court in respect of item No.1 to 10 properties?”
12. It is also emphasized that there is a prayer in the plaint with regard to cancellation of registered partition dated 08.02.2018, but no proper issues were framed by the Trial Court. Therefore, the judgments of the Trial Court as well as the First Appellate Court need to be reviewed while admitting the appeal. 13. Per contra, learned counsel for the contesting respondents Sri Shridhar N Hegde supports the impugned judgments. 14. Having heard the arguments of both sides this Court perused the material on record meticulously. 15. On such perusal of the material on record it is crystal clear that parties had entered into a partition and it was reduced into writing and the same was also registered before the jurisdictional Sub-Registrar on 08.02.2018. - 22 -

16. It is the case of the plaintiffs as could be seen from the plaint averments that very next day i.e., on 09.02.2018 there was an oral partition. 17. According to the plaintiffs, the said oral partition was in respect of remaining properties which are left out in the registered partition deed dated 08.02.2018. 18. Plaintiff's further case is that signature on the partition deed which was registered on 08.02.2018 and for the Jubani partition (oral), signatures of the plaintiffs were obtained by force and therefore, both the partitions are fraudulent in nature and did not bind the plaintiffs. 19.
The suit on contest came to be dismissed by the Trial Court. 20. First Appellate Court in the appeal filed by the plaintiffs, re-appreciated the material on record and noted that item No.20 of the suit properties was not the property that was subject matter of registered partition deed dated 08.02.2018 and therefore allowed the appeal of the plaintiffs in part by granting 1/9th share in item No. 20 of the suit property. - 23 -

21. Being further aggrieved by the dismissal of the suit in respect of other items of the property, appellants are before this Court. 22. Sri Hareesh Bhandari T, would contend that both the Courts did not take into consideration that when the fraud is alleged in respect of written partition which was registered on 08.02.2018 and Jubani partition which was entered on the very next day i.e., on 09.02.2018, the Trial Court ought to have considered the case of the plaintiffs on the basis of the material evidence placed on record and the properties involved in both the partitions. It is his further argument that both the Courts failed to do so. 23. In this regard, this Court perused the material on record meticulously especially the reasons assigned by the learned Trial Judge as well as the learned Judge in the First Appellate Court. 24. Learned Trial Judge while dealing with the issue Nos.1 and 2, has categorically recorded a finding that the burden to establish that the signatures of the plaintiffs were obtained under threat to registered partition deed on

08.02.2018 and Jubani partition deed dated 09.02.2018 was on the plaintiff. But, plaintiff failed to discharged said burden. In this regard, except reiterating the plaint averments by PW1 to PW3, there is no other material evidence on record. 25.
In fact, Trial Court has noted that in the cross examination of PW4 that, there is an admission that the signatures were obtained in the Sub Registrar's Office and there was no resistance while obtaining the signatures in the office of the Sub Registrar at Davangere. 26. Sri Manjunath of Bullapura is a witness to the said registered partition deed. But the plaintiffs have not cited him as a witness and examined him on their behalf. 27. On the contrary, said Manjunath is examined as DW3. He has supported the case of the defendants that plaintiffs voluntarily signed Ex.P1 and there was no threat or fraud played while obtaining the signatures of the plaintiffs on Ex.P1 which is the registered partition deed dated 08.02.2018. 28. In other words, the contentions urged on behalf of the plaintiffs that the signatures on registered partition deed

and Jubani partition deed was under the threat and therefore it is a fraudulent document is not established by placing necessary material evidence on record. Therefore, rejection of the suit by the learned Trial Judge was just and proper. 29. Learned Judge in the First Appellate Court did re- appreciate the material on record and it is evident from the fact that the First Appellate Court has allowed the appeal in part in as much as the First Appellate Court has granted 1/9th share to the plaintiffs in item No. 20 of the suit properties. 30. Learned Trial Judge has ignored the said aspect of the matter while dismissing the suit in toto. 31. Learned judge in the First Appellate Court also noted that a party who is a signatory to the registered document cannot turn around and then pray that the document is a fraud. 32. Further, order VI Rule 4 of Code of Civil Procedure contemplates that if a party to suit is alleging the fraud in a given case, specific details as to the fraud played on them must

be not only pleaded but should be proved so as to allow the contesting party to meet the alleged fraud. 33.
On perusal of the plaint such material particulars are not forthcoming. Therefore, only on the say of the plaintiffs that the registered partition deed entered on 08.02.2018 and so also the Jubani partition deed entered on 09.02.2018 are fraudulent documents is rightly rejected by both the Courts. 34. Thus, this Court does not find merit in any one of the substantial questions of law. 35. Accordingly, the following:
ORDER (i) Admission is declined. (ii) Appeal is dismissed.
