JUSTICE MADHU JAIN O R D E R % 06.10.2026 1. This hearing has been conducted through hybrid mode. 2. The present petition has been filed by the petitioner under Sections 528 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking setting aside of the order dated 19.06.2026 passed by the learned Vacation Judge/ASJ-01, Shahdara, Delhi, whereby transit anticipatory bail was granted to respondent Nos. 1 and 2 in connection with FIR No. 03/2025 registered at Police Station Cyber Thana (Range Sarguja), District Surguja, Chhattisgarh. The petitioner also seeks cancellation of the transit anticipatory bail granted to the said respondents. This is a digitally signed order. Learned counsel appearing for respondent Nos. 1 and 2 reiterates that the present petition has become infructuous, as the period of transit anticipatory bail granted to the respondents has already expired. It is submitted that the respondents thereafter preferred an application seeking anticipatory bail before the High Court of Chhattisgarh, which came to be dismissed, and that they have subsequently approached the Hon’ble Supreme Court by way of a Special Leave Petition. 4. Learned counsel for the petitioner does not dispute the aforesaid position. He, however, submits that the conduct of respondent Nos. 1 and 2 may be recorded, in as much as they allegedly filed a false affidavit before the learned Trial Court stating that they had no previous criminal antecedents, despite four FIRs having been registered against them. 5. Heard the learned counsel[s] for the concerned parties. 6. In view of the fact that the period of transit anticipatory bail has already expired and the respondents have availed their remedies thereafter, nothing further survives for consideration in the present petition. Accordingly, the present petition is disposed of as having become infructuous. 7. The order be uploaded on the website forthwith. MADHU JAIN, J OCTOBER 6, 2026/b/PG This is a digitally signed order.
