Virender Singh, Judge (Oral) Notice issued to the respondent received back after due service. Despite service of notice, respondent  has not bothered to put appearance. In such situation, further wait is not justifiable. As such, the present petition is being decided. 2. Petitioner–Arti Devi has approached this Court, by way of the present petition, under Section 24 of the Code of Civil Procedure (hereinafter referred to as ‘the CPC’), seeking transfer of Petition, under Sections 7 and 25 of the Guardians 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 2026:HHC:10763 and Wards Act (hereinafter referred to as ‘the Act’), bearing registration No.1 of 2025, titled as Kamaljeet versus Arti Devi, instituted   by   the   respondent­husband   before   the   Court   of learned Senior Civil Judge, Nurpur, District Kangra   to the Court   of   learned   Senior   Civil   Judge,   Hamirpur,   District Hamirpur, H.P. 3. According to the petitioner­wife, she was married to respondent­husband, on 30.07.2010, as per Hindu rites and rituals and out of the said wedlock, the parties to the lis have been blessed with child, namely Poorvansh Chouhan. 4. As   per   the   petitioner­wife,   the   petitioner   and respondent remained with love and affection, however, in the year 2017, the respondent­husband started misbehaving with the   petitioner­wife   and   started   treating   her   with   cruelty. Ultimately, she was ousted from the matrimonial home and compelled to take shelter at her parental house. 5. It is the further case of the petitioner­wife that she and her son, who is studying in 8th standard, are living with her parents and they are totally dependent upon the parents of the petitioner. 3 2026:HHC:10763 6. According   to   the   petitioner­wife,   thereafter,   she made   a   complaint   against   the   respondent­husband   to   the police, which was settled as the respondent­husband tendered apology. Now, the respondent­husband has filed the petition, under Sections 7 and 25 of the Act, before the Court of learned Senior Civil Judge Nurpur, District Kangra, H.P. 7. On the basis of the above facts, a prayer has been made to allow the petition. 8. Along with the present petition, the petitioner­wife has   annexed   the   photocopy   of   the   petition,   filed   by   the respondent­husband,   under   Sections   7   and   25   of   the   Act. Despite   service   of   notice,   respondent­husband,   has   not bothered to put appearance before this Court to controvert the allegations,   which   have   been   levelled   in   the   transfer application. Meaning   thereby,   whatsoever   asserted   by  the petitioner­wife, which is duly supported by the affidavit, has not been controverted by the respondent­husband. 9. Considering the fact that the convenience of the wife   is   paramount   consideration,   in   such   type   of   matters, coupled   with   the   fact   that   whatsoever   pleaded   by   the 4 2026:HHC:10763 petitioner­wife, in the petition, remained uncontroverted,  this Court is of the view that the present petition is liable to be allowed. 10. Consequently, the petition is allowed and the case bearing registration No.1 of 2025, titled as Kamaljeet versus Arti Devi, pending adjudication before the Court of learned Senior Civil Judge, Nurpur, District Kangra is transferred to the Court of learned Senior Civil Judge, Hamirpur, District Hamirpur, H.P. 11. Learned   Senior   Civil   Judge,   Hamirpur,   District Hamirpur, H.P., is requested to proceed further, after securing the presence of both the parties. 12. Pending miscellaneous application(s), if any, shall also stand disposed of. 13. A copy of this order be sent to the Court of learned Senior Civil Judge, Nurpur, District Kangra, H.P., as well as, to the Court of learned Senior Civil Judge, Hamirpur, District Hamirpur,  H.P., for compliance.
