The contention of the learned counsel for the petitioners is that as per the policy decision, the respondents ought to have considered the request of the petitioners to allot the land as the

petitioners are the surrendered naxalites/extremists by granting patta. 4. Initially the land in Survey No.40-1 to an extent of Ac.2.00 cents and Survey No.41-1A to an extent of Ac.2.29 cents situated in Itikalapalli Village of Anantapuram Rural Mandal, Anantapuram District was assigned to one A.Kullayappa but, violating the conditions of assigned patta he did not occupy and cultivate the said land and kept the same as waste land.
Therefore, the respondents took steps for resumption to the Government under violation of conditions of assigned patta by issuing notice dated 07.02.2015 by cancelling the assigned patta issued in his favour calling explanation why the land was so assigned to him for resumption to the Government. Aggrieved by the same, he approached this Court by filing W.P.No.4522 of 2015 and as per the directions, the Tahsildar has passed resumption orders and as against the same, no appeal has been filed. Accordingly, the Revenue Divisional Officer, Anantapuram has directed to take necessary action for assignment of agricultural land in Survey No.40-1 to an extent of Ac.2.00 cents and Survey No.41-1A to an extent of Ac.2.29 cents situated in Itikalapalli Village of Anantapuram Rural Mandal, Anantapuram District to the

petitioners for agricultural purpose and the same would be passed under BSO-15 and as per G.O.Ms.No.250, Revenue (Assn.I) Department, dated 15.05.2018. 5. Learned Assistant Government Pleader has submitted that the respondents requested short time to complete the process. 6. Accordingly, the Writ Petition is disposed of directing the respondents, more specifically respondent Nos.2 to 4, to consider the request of the petitioners to allot the land and pass appropriate orders within a period of four (4) months from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
