Learned State counsel pointed out that one of the eye-witness has been examined therein, it is mentioned that he was re-examined after arrest of applicant, which was subsequently and has not filed the deposition of the other eye-witness of their re-examining. 2. Learned counsel for applicant submits that he will verify the position in this regard and seeks permission of this Court to withdraw this application with liberty to repeat the prayer along with deposition sheet of the witnesses, if available. 3.
