ORAL ORDER
1. The Petitioner is before this Court seeking for the following reliefs: a. Direct the Respondent No.2 to release the convict, namely Paramesha S/o Venkatesha (CTP-1108), lodged in Open Air Prison, Devanahalli, on general parole for a period of 90 days in the interest of justice;
b. Pass any other order (s) or direction(s) which this Hon'ble Court may deem fit and proper under the
facts and circumstances of the case, in the interest of justice.
2. The Petitioner claims that the detenu has been recommended for premature release by the Advisory Board and in furtherance thereof that a parole has been sought for. The detenu having been in custody for a period of nearly 13 years, 11 months and 5 days.
3. Once a recommendation has been made for premature release, an application for parole cannot be rejected as done in the present case. Subject to the acceptance of the recommendation by the

Competent Authority, respondents ought to have released the detenu on parole so as to help in the reintegration of the detenu in the general society.
4. In that view of the matter, this Court passes the following:
ORDER i) The Writ Petition is allowed. ii) Respondent–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu-Paramesha B.V. (CTP.No.1108) on parole until orders are passed by the Appropriate Authority commencing from 18.06.2026, subject to the following conditions: a) The prisoner-detenu-Paramesha B.V. (CTP.No.1108) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole.

b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the
order to the prison authority for its immediate execution. iv) It is, however, made clear that in the event of the Appropriate Authority rejects the recommendation made by the Advisory Committee, the petitioner, the detenu would have to immediately surrender to the jail authorities.
