W.P.No.4225_2014 THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 4225 of 2014
ORDER:
1. The learned counsel appearing for the petitioner submits that the petitioner is aggrieved by the inaction on the part of respondent Nos.1 to 3 in not absorbing the petitioner in the respondent bank as a Probationary Officer even after completion of one year of the Post Graduate Diploma in Banking and Finance. The learned counsel further submits that the petitioner had applied for selection and admission to the IV batch of the PG Diploma course and spent about Rs.4,00,000/- towards completion of the course. It is also submitted that, the petitioner’s request, an educational loan was extended to her. It is further submitted that the petitioner completed the course, including the internship, before August 2013. 2. However, the respondent bank refused to absorb the petitioner into service on the pretext that the petitioner had failed to complete the course within a period of one year. In this regard, the petitioner submitted a detailed representation dated 14.12.2013 seeking the indulgence of the respondent bank in consider the case of the petitioner for absorption. The learned counsel appearing for the petitioner submits that the petitioner had completed the course within the stipulated time; however, the 5th respondent could not release the results within time, and on account of the results being declared in October 2013, the petitioner could not comply with the requirement of

HN, J
W.P.No.4225_2014 completing the course within a period of one year, as stipulated by the respondent bank. 3. The learned Standing counsel appearing for respondent Nos.1 to 4 submits that a detailed counter has been filed and that the recruitment in question relates to the year 2014. It is further submitted that the petitioner has not arrayed the officers who were recruited at that point of time as party respondents. It is also submitted that, insofar as respondent bank is concerned, the issue has been closed from their end, as the petitioner did not meet the eligibility criteria for appointment. It is submitted that the maximum period for completion of the course is one year three months, or alternatively, the petitioner ought to have completed the course in a single attempt. Since the petitioner did not meet the said eligibility conditions, she was not considered for absorption. The petitioner cleared the backlog papers in the third attempt, and the recruitment regulations do not entitle a candidate to claim absorption under such circumstances. 4.
Heard the learned counsel for petitioner and the learned Standing counsel for respondent Nos.1 to 4, appearing virtually. Perused the record. 5. The grievance of the petitioner seeking a direction to the respondent bank to absorb the petitioner as a Probationary Officer cannot be considered by this Court after the lapse of more than ten years. The primary eligibility criteria for considering any candidate for absorption as a Probationary Officer is that the applicant must complete the course within duration of one year. In
5
HN, J
W.P.No.4225_2014 the event, the applicant is unable to complete the course within the said period, the offer of placement issued by the respondent bank stands automatically withdrawn. Paragraph 11 of the admission letter clarifies the position. On the facts of present case, admittedly, the petitioner did not meet this eligibility criterion and, accordingly, the petitioner was not considered for absorption. That apart, the petitioner has not challenged the recruitment of other Probationary Officers by impleading them as party respondents to the present writ petition. 6. Considering the submission that the petitioner did not meet the eligibility criteria, this Court cannot interfere in the recruitment process and pass an
order directing the respondents to absorb the petitioner as a Probationary Officer, unmindful of the Recruitment guidelines and regulations. On these considerations, the writ petition deserves to be dismissed. There shall be no
order as to costs. Pending miscellaneous petitions, if any, shall stand closed.
