On the request of learned counsel appearing on behalf of the petitioner, the present writ petition is taken up and heard for final disposal at the admission stage. 2. The present writ petition has been filed challenging the inaction on the part of the respondents in not disposing of the [2026:RJ-JP:16539] (2 of 3) [CW-6763/2026] resignation dated 25.11.2025 (Annex.8) submitted by the petitioner. 3. The facts disclose that the petitioner is working in the cadre of Assistant Manager with the respondent-Bank. Learned counsel appearing on behalf of the petitioner submits that the petitioner submitted his resignation on 25.11.2025, and the respondent- Bank could not accept the said resignation as disciplinary proceedings were pending against the petitioner vide proceedings dated 25.06.2025. Now, the proceedings dated 25.06.2025 have been concluded vide punishment order dated 12.04.2026 by reducing/deducting one increment for a period of one year. As of now, there are no other proceedings preventing the respondent from taking a decision on the resignation submitted by the petitioner; therefore, he prays for a decision on the said resignation at the earliest. 4. Rule 24 of the IDBI Limited Officers (Discipline and Appeal) Rules, 2006 (hereinafter referred to as “the Rules of 2006”) deals with resignation. Sub-rule (1) of Rule 24 of the Rules of 2006 requires three months’ notice in the case of regular officers and one month’s notice in respect of management trainees who are yet to be absorbed into the Bank’s service and officers who are yet to be confirmed in the Bank’s service. The petitioner is a confirmed officer; as such, three months’ notice is required to be given. The resignation notice was given on 25.11.2025, which means that more than five months have elapsed, and even the disciplinary proceedings have been concluded; therefore, the respondents are bound to consider his resignation and pass an appropriate order. In view of the above, the present writ petition is disposed of with a direction to the respondents to take a decision on the resignation dated 25.11.2025 (Annex. 8) within a period of 15 days from the date of receipt of a certified copy of this order. 6.
