JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 6 are before this Court calling in question registration of a crime in Crime No.13/2026, pending before the XI Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru, for the offences under Sections 85, 352 and 3(5) of the BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri Syed Mohammed Irbaz, learned counsel for petitioners, Smt. Waheeda M.M., learned High Court Government Pleader for respondent No.1 and Sri Shakeel Ahmed, learned counsel for respondent No.2. 3. Learned counsel for petitioners and respondent No.2 in unison submit that the parties to the lis have arrived at settlement and the couple have reunited. They have drawn certain terms and conditions of settlement and the terms are agreed upon by them. They have filed a joint affidavit before this Court to that effect. - 4 - HC-KAR NC: 2026:KHC:27501 CRL.P No. 6665 of 2026 4. The joint affidavit reads as follows: “I, Mr. SYED MUNAWAR, S/o. Syed Anwar, Aged about 38 years, Mrs. Khatija Bi, W/o Syed Anwar, Aged about 65 years, Mrs. Shaheeda, S/o Syed Anwar, Aged about 43 years, Mrs. Akheela, D/o Syed Anwar, Aged about 45 years, Mr. Shaik Usman, S/o Shahbaz Pasha, Aged about 24 years, Ms. Faiza, D/o Shahbaz Pasha, Aged about 17 years, all are R/at: No.181, Near Inamul Masjid, Govindapura, Sarvodya Nagara, Nagawara, Bengaluru- 560 045 and Mrs. RUMANA, W/o. Syed Munawar, Aged about 25 years, R/at: 11th cross, Hidayath Nagar, Bengaluru 560045, now today Bengaluru, do hereby solemnly affirm and state on oath as follows:-are 1. We state that we are aware about the filing of the above proceedings. We know the facts circumstances of the case. Hence, we are swearing to this affidavit. 2. We state that, the complainant have filed a complaint against the Petitioners before Pulakeshinagar Sub-Division, Bengaluru in Crime No.13/2026 dated 04.02.2026 on the offence punishable under section 85, 352, 3(5) of BNS Act, and under section 3 & 4 of Dowry Prohibition Act pending before the XI Addi, Chief Metropolitan Magistrate, Mayohall at Bengaluru. 3. We state that, now at the intervention of well- wishers have and common friends we have compromised the above matter amicably to maintain the good relationship between us and Petitioner No.1 and Respondent No.2 have reunited and accordingly they have started a new life and staying together as husband and wife. 4. We further states that, we have withdrawn the allegations made against each other before respective - 5 - HC-KAR NC: 2026:KHC:27501 CRL.P No. 6665 of 2026 courts. Therefore, we have reunited and settled our dispute once for all and intending to lead a happy marital life. 5. We further states that now, the complainant have agreed to withdraw the above case filed against all the Petitioners/ Accused and also agreed to withdraw all the criminal proceedings pending before the other Courts. Therefore, we may be permitted to compound the above offences as mentioned in the said Crime No.13/2026 pending before the XI Addl. Chief Metropolitan Magistrate, Mayohall at Bengaluru for the offence punishable under section 85, 352, 3(5) of BNS Act, and under section 3 & 4 of Dowry Prohibition Act may be quashed accordingly. 6. We, the deponent above named do hereby declare that what is stated above is true and correct to the best of our knowledge, information and belief and this is our name and signature.” In the light of the afore-quoted joint affidavit, though the offence alleged against the petitioners in the case at hand inter alia is the one punishable under Section 85 of the BNS, as it is a matrimonial dispute and the couple have reunited and living together happily, I deem it appropriate to terminate the proceedings against the petitioners. 5. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. - 6 - HC-KAR NC: 2026:KHC:27501 CRL.P No. 6665 of 2026 (ii) The impugned crime in Crime No.13/2026, pending before the XI Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru, stands quashed.
