Considering the submission that the appellant is in jail in another case and on account of this reason he could not be released even after suspending his sentence in the present case vide order dated 14.01.2025, in the interest of justice, it would be appropriate to direct the appellant to appear before this Court through video conferencing at 12.30 pm today itself, in order to obtain necessary information about the Criminal Case in which he is presently in Jail. The Registrar Judicial shall make necessary arrangements for taking up this case again at 12.30 pm

Chief Justice Later on- The accused Amar Prajapati appeared through Video Conferencing from Central Jail Ambikapur. He has been identified by Shri A.K. Bajpai, Assistant Jail Superintendent, Central Jail, Ambikapur. On a query being made, the appellant submits that he has already been convicted in Sessions Case No.105/2019 by the Ist Additional Sessions Judge, Ramanujganj, vide judgment dated 04.08.2025, against which, he preferred CRA No.2358 of 2025 before Single Bench of this court in which his appeal is partly allowed and while maintaining his conviction, his sentence was reduced from RI of 10 years to RI of 7 years. In view of the fact that the appellant has already been convicted in CRA No.2358 of 2025, we proceed to hear the present appeal finally with the consent of the parties concerned.
