This is a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of FIR No. 0074/2024, dated 23.02.2024, registered at P.S Baba Haridas Nagar, New Delhi under Sections 279/304A IPC and all proceedings emanating therefrom on the basis of settlement between the parties. 4. The factual matrix giving rise to the present case is that on 22.02.2024, at about 9:10 p.m., an accident took place on the Main Bahadurgarh-Najafgarh Road near the Main Gate, PTC Jharoda Kalan, Baba Haridas Enclave, Delhi, involving the petitioner's vehicle bearing registration No. HR-95B-3887 and deceased Raj Singh, aged about 69 years. A PCR call was received informing the police that a car had struck an elderly man. The caller stated that the driver had taken the injured person in the vehicle and proceeded towards Bahadurgarh. Upon reaching the spot, the police found neither the injured person nor the vehicle, and subsequently received MLC intimation from RTRM Hospital, Jaffarpur. At the hospital, the victim Raj Singh was declared brought dead. 5. Charge-sheet was thereafter filed and the criminal case, Cr. Case 202149/2024 titled State v. Neeraj, is pending before the learned JMFC, Dwarka Courts, with the matter stated to be fixed for prosecution evidence. 6. During the pendency of the criminal proceedings, the legal heirs of the deceased instituted MACT proceedings and the claim was Signed By:VAISHALI PRUTHI Signing Date:08.10.2026 15:15 Signature Not Verified CRL.M.C. 7548/2026 Page 3 of 4 settled for a sum of Rs. 8,00,000/- (Rupees Eight Lakhs Only) in full and final settlement. 7. It is submitted that with the intervention of relatives, friends and respectable members of society, the petitioner and respondent Nos. 2 to 5 have amicably resolved their disputes and executed a Deed of Settlement dated 25.05.2026. The respondents expressly stated that they are not left with any grievance against the petitioner and did not wish to pursue the criminal proceedings. They also executed no- objection affidavits in support of the present petition. Copy of the Deed of Settlement dated 25.05.2026 has been annexed as Annexure P-3. 8. Petitioner is present in person while respondents no. 2 to 5 are present though video conferencing before the Court. They have been identified by their respective counsels as well as by the Investigating Officer SI Sachin and Insp. Amit Kumar, from PS BHD Nagar. 9. Respondent Nos. 2 to 5 confirm that the matter has been amicably settled with the petitioner without any force, fear, coercion and they have no objection if the FIR No. 0074/2024 is quashed against the petitioner. 10. In view of the settlement between the parties, learned Additional PP appearing for the State, also has no objection if the present FIR No. 0074/2024 is quashed. 11. In Gian Singh vs State of Punjab (2012) 10 SCC 303, Hon’ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under: - Signed By:VAISHALI PRUTHI Signing Date:08.10.2026 15:15 Signature Not Verified CRL.M.C. 7548/2026 Page 4 of 4 "61. In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceedings." 12. In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, it would be in the interest of justice, to quash the abovementioned FIR and the proceedings pursuant thereto. 13. In the interest of justice, the petition is allowed, and FIR No. 0074/2024, dated 23.02.2024, registered at P.S Baba Haridas Nagar, New Delhi under Sections 279/304A IPC and the other consequential proceedings emanating therefrom are hereby quashed. 14.
