2 CRA No. 855 of 2025, vide order dated 17.06.2025, though declined to grant bail, expressed a hope and trust that the learned trial Court would make an earnest endeavour to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of the said order, if there was no legal impediment. 3. Thereafter, the learned Special Judge (NIA), Rajnandgaon, vide communication dated 16.12.2025, sought extension of time for conclusion of the trial. Considering the reasons assigned therein, this Court, vide order dated 16.01.2026, granted a further period of four months to conclude the trial. 4. Now, the learned Special Judge (NIA), Rajnandgaon, vide communication/request letter dated 14.05.2026, has once again sought extension of time and has requested that a further period of four months be granted for conclusion of the trial. 5. It transpires from the perusal of the PUD that the learned Special Judge (NIA), Rajnandgaon has duly apprised this Court about the present stage of the trial in Special Case (NIA) No. 29/2024. The delay in the trial has occurred mainly due to the voluminous nature of evidence, repeated and lengthy examination and cross-examination of witnesses, particularly the Investigating Officer, whose examination-in-chief and cross-examination consumed several hearing dates. Certain witnesses could not be examined on scheduled dates owing to non-service of summons, health issues, and procedural difficulties.
The case involves serious offences under the Unlawful Activities (Prevention) Act and related statutes,
3 requiring adequate opportunity to both parties for leading evidence. Further, the Court is simultaneously dealing with several custody and time-bound NIA cases. Though as many as 33 prosecution witnesses have been examined till date, despite continuous efforts and grant of consecutive dates, the prosecution evidence is still in progress and, therefore, the trial could not be concluded within the prescribed time. 6. The request appears to be reasonable. The concerned Trial Court is, therefore, directed to make all possible endeavors to conclude the trial at the earliest, preferably within a further period of four months from today. 7. Accordingly, CRMP stands disposed off with the aforesaid direction. 8. Registry is directed to send a certified copy of this order to the trial court concerned for necessary information and compliance.
