JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: “WHEREFORE, the Petitioners pray that this Hon'ble Court may be pleased to pass an order quashing the entire proceedings in C.C 16745/2024 arising out of Final Report dt.07.02.2024 registered by the Respondent No.1 Hebbal P.S in Cr.No.239/2023 dt.19.10.2023 for the offences punishable under Sections of 34, 355, 354, 323 of I.P.C pending before the Ld. VIIIth Addl. Chief Metropolitan Magistrate, Bengaluru City to meet the ends of justice.” - 3 - HC-KAR NC: 2026:KHC:28050 CRL.P No. 3817 of 2025 2. Heard Sri. Rajath, learned counsel appearing for the petitioners, Sri.Rashmi Patel, learned HCGP appearing for respondent No.1 and have perused the material on record. 3. During the subsistence of the proceedings, the parties to the lis have entered into a settlement and have settled the dispute by filing Joint Memo drawing up certain terms of settlement. The Joint Memo filed by the parties to the lis reads as follows: “1) Both the parties have entered into a Compromise Agreement today to amicably settle the matter. Both the parties have agreed to withdraw above case. The Complainant has agreed to withdraw the above cases pending before this Hon'ble Court against the Accused. 2) The Accused (Smt.Jayasheela) has agreed to withdraw the complaint lodged against the Complainant for quashing C C No.16745/24 (Crime No.239/2023) in Crl.Petition No.3817/2025, which is pending before the Hon'ble High Court of Karnataka. 3) To this effect both the parties are filing Joint Affidavit, undertaking that they will co-operate with the closure of the above cases. 3a) The Accused, Jayasheela has agreed to co- operate with the quashing of the proceedings registered against the Complainant and his family members herein, pending consideration before the Hon'ble High Court of Karnataka in Crl. Petn No.3817/2025. 4) Further both the parties undertake not to interfere in peaceful living life and the movement of either of them and that all cases filed against each other, - 4 - HC-KAR NC: 2026:KHC:28050 CRL.P No. 3817 of 2025 both civil and criminal is hereby amicably settled and shall have no effect… (sic) Wherefore, it is humbly prayed that this Hon'ble Court be pleased to allow this Joint Memo and pass Judgement Orders, in the interest of Justice.” 4. In the light of the settlement arrived at between the parties and Joint Memo quoted supra having being filed and offences not being against the State, I deem it appropriate to accept the said Joint Memo and close the proceedings against the petitioners. Hence, the following: O R D E R [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.16745/2024 pending before the VIII ACMM, Bengaluru City, qua the petitioners, stand quashed.
